<br />Councilmember Backous introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #14-08-141 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0931 RELATING TO A REQUEST <br />FROM FAULK AND FOSTER FOR AN AMENDMENT TO A CONDITIONAL USE <br />PERMIT REALTED TO A CELLULAR TOWER TO INCREASE THE AREA OF THE <br />LEASED PORTION OF PROPERTY AT 14650 FERRET ST NW <br /> <br />WHEREAS <br /> , Faulk and Foster on behalf of Crown Castle International, hereinafter <br />referred to as “Applicant,” has properly applied for an amendment to a Conditional Use Permit <br />(the “Permit”) to expand the leased area on the property generally known as 14650 Ferret St NW <br />and legally described as follows: <br /> <br /> Lot 1, Block 1, HY-10 RAMSEY, Anoka County, Minnesota <br /> <br /> (the “Subject Property”) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA <br />, as follows: <br /> <br /> <br />1.That the Subject Property is approximately 4.3 acres in size and is owned by KRH Land, <br />LLC (the “Property Owner”). <br /> <br /> <br />2.That the Subject Property is currently zoned COR-2. <br /> <br /> <br />3.That the parcel northwest of the Subject Property is zoned B-2 Highway Business; all other <br />surrounding parcels are zoned COR-2. <br /> <br /> <br />4.That the City approved a conditional use permit in 1996 to allow the initial installation of <br />a wireless communications tower and supporting ground equipment in a fifty foot by fifty <br />foot (50’ x 50’) ground lease space (the “Leased Area”). <br /> <br /> <br />5.That the conditional use on the Subject Property is a 165 foot self-supporting lattice tower <br />and related equipment cabinets within the Leased Area, which the Property Owner is <br />leasing to the Applicant. <br /> <br /> <br />6.That the Subject Property and surrounding parcels were zoned Industrial at the time the <br />Permit was granted and adhered to standards for that zoning district. <br /> <br /> <br />7.That the distance from the east edge of the Leased Area to the street side property line of <br />the Subject Property is fifty-five (55) feet, exceeding the required setback distance of forty <br />(40) feet for the previously existing Industrial zoning district. <br /> <br /> <br />8.That the Applicant is proposing an amendment to the Permit that expands the Leased Area <br />to the south and west by six hundred forty-eight (648) square feet, or eighteen (18) feet by <br /> <br />
