PROPOSED MOTION <br /> <br />Move to adopt the following attached items: <br />a) An ordinance amending Chapter 5 of the City Code (Subdivision Regulations) to adopt <br /> definitions and requirements for dedication of land for parks and open space; and <br />b) A resolution repealing Resolutions 2001-043 and 2001-044, which previously set park <br /> dedication requirements and will be made obsolete by the proposed ordinance. <br /> <br />Approval of amendments to the City Code and adoption of res°lutions require a 4/7 vote of the <br />City Council. <br /> <br />2. BACKGROUND <br /> <br />Staff is in the process if drafting new Subdivision Regulation for the. City. It has been many <br />years since an update, and the need for new regulations has been identified as an important step <br />to implement the City's revised Comprehensive Plan -and to bring the regulations up to date. <br /> <br />One of the key sections of the Subdivision Regulations needing an update contains the <br />requirements for dedication of land, or cash in lieu, for parks and open space. The current <br />regulations and the accompanying policy resolution which determine the formulas for park <br />dedication need to be consistent with the Comprehensive Plan and state law in order to be legally <br />defensible. The amount of dedication required should be clearly tied and proportionate to the <br />need for park facilities generated by the development. <br /> <br />Staff is recommending that the City Council adopt, the park dedication section of the revised <br />subdivision regulations in advance of the entire ordinance. The park dedication requirements <br />(particularly the cash-in-lieu of land fees) are typically updated annually. The remainder of the <br />ordinance will be revised in early 2002. <br /> <br />?.4 <br /> <br /> <br />
