Councihnember Kurak stated that if the City has to pay for research they should pass the cost <br />back on to the person making the request. <br /> <br />City Attorney Goodrich reviewed who is responsible for handling data requests for the City. <br /> <br />Councilmember Elvig stated that the City is going through some tough budget times and they <br />already have limited staff so the City will either have to establish a fee for research requests or <br />not do it at ali. <br /> <br />City Attorney Goodrich presented the Council with a copy of the City's data request cost <br />calculation form for their review. <br /> <br />Mayor Gamec inquired if it would be possible for the City to require a cashier's check up front <br />for any research issue and then when the research is completed the City would reimburse any <br />remaining funds. <br /> <br />City Attorney Goodrich replied that that was a possibility. He stated that as the City grows, staff <br />should probably train a specific staff member to be more proficient on using the form and <br />determining the amount of time it will take to process the request. <br /> <br />Mayor Gamec suggested that they require 75 percent of the fee up front so that they lcnow the <br />City will be paid for research they do even if the person decides not to pick the information up. <br /> <br />City Attorney Goodrich noted that the City could request 100 percent of the fee up front. <br /> <br />Mayor Gamec requested that staff put together a fee schedule and bring it back for Council <br />review. <br /> <br />Councilmember Strommen stated that they have to have some sort of definition as to what would <br />be considered a research item. <br /> <br />City Attorney Goodrich noted that ordinances, minutes, agendas, resolutions, would not be <br />research items because that infonnation is readily available. <br /> <br />Councihnember Kurak stated that any research that is done by City staff should be billed back <br />including anything that requires City Attorney time. <br /> <br />City Administrator Norman stated in regards to the business list they could remove the telephone <br />numbers from the list. <br /> <br />Mayor Gamec explained that the complaints he received from the business owners had to do with <br />the telephone solicitation they have been receiving in addition to the $15.00 fee they are being <br />charged every year for the City creating the list. <br /> <br />City Council Work Session/November 10, 2003 <br /> Page 4 of 7 <br /> <br /> <br />
