CASE <br /> <br /> REQUEST FOR VACATION OF EASEMENTS IN <br /> TRANBY TERRACE 2m> ADDITION; <br /> CASE OF ROBERT LETENDRE <br />By: Sylvia Frolik, Community Development DirectOr <br /> <br />Background: <br /> <br />The City Council recently approved the plat of Letendre Addition. Letendre Addition is a replat <br />of Lots 2 and 3, Block 1, Tranby Terrace 2nd Addition into 3 rural single'family lots. Each of the <br />2 pre-existing lots in Tranby Terrace 2na Addition contained the standard drainage and utility <br />easements around the perimeter. Also, Lot 3 of Tranby Terrace 2nd Addition contained a 33 foot <br />wide drainage, and utility easement along the north boundary to apparently preserve a corridor in <br />the event 171st Avenue were extended to the west side of Tiger Street. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Final plat of Letendre Addition <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, a public hearing is required to consider vacation of easements. <br />City Staff attempted to notify property owners within 350 feet of the subject property of the <br />public hearing to vacate easements. <br /> <br />Observations: <br /> <br />The easements dedicated around the perimeter of the reconfigured lots in Letendre Addition <br />conflict, with the easements that were dedicated as part of Tranby Terrace 2nd Addition. The <br />process of replatting does not vacate any pre-existing easements of record. The only way to <br />eliminate the pre-existing easements of record is by City Council ordinance. <br /> <br />With the replat of the property, Lot 3 of Tranby Terrace 2'd Addition was narrowed and as a <br />result, that 33 foot drainage easement is now part of Mr. Letendre's homestead. Mr.. LeTendre's <br />homestead is the on/y lot that can be further subdivided in accordance with current zoning <br />regulations. However, any additional subdivision of his homestead will require construction of a <br />public road into the property. Since he now owns all of the property necessary for a 66 foot road <br />right-of-way to extend 171st Avenue N.W. to the west side of Tiger Street, it is no longer <br />necessary to encumber the pre-existing 33'x 380' foot strip with a drainage and utility easement. <br /> <br />-173- <br /> <br /> <br />
