noxious odor. It may be a situation where they have overstayed their welcome. When they first <br />moved into the City the area was a lot less developed. <br /> <br />Councilmember Strommen stated that it concerns her when they have other businesses that have <br />employees that might have to go home because of the odor. <br /> <br />Director of Public Works/Fire Chief Kapler wanted to be clear that staff does not come forward <br />with a suggestion or an opinion on how to handle the situation. <br /> <br />Mayor Gamec suggested that the City Attorney review the infonnation. <br /> <br />Councilmember Zimmerman stated that the MPCA has some input on the use and they have not <br />issued any negative complaints against Commercial Asphalt. <br /> <br />Councilmember Cook stated that the plant meets and exceed the requirements for what they are <br />releasing so they have to handle the issue very carefully. <br /> <br />Councihnember Stromrnen suggested that the City Council discuss the issue at a work session. <br /> <br />Case #10: Consider Establishment of the Town Center Review Board <br /> <br />City Administrator Norman requested that the item be tabled until December 16th. <br /> <br />Motion by Councilmember Cook, seconded by Councilmernber Strommen, to table action until <br />December 16th. <br /> <br />Further discussion: Councilmember Elvig stated that he was concerned with staff spending more <br />time on the issue developing an ordinance because that would mean it would be a commission. <br />He felt that there would be a real conflict with the Town Center Review Board being parallel to <br />the Planning Commission. City Administrator Norman replied that that is why staff would like <br />more time to discuss the issue. There are some items that work parallel with the Planning <br />Commission, but there are some items that have nothing to do with Planning Commission such <br />as deter~nining the types of businesses, themes of the buildings, etc. Councilmember Elvig stated <br />that there are a lot of things that would be strictly in conflict with the Planning Commission, <br />which is why he would recommend that the Review Board be established as a committee and if it <br />is detmrnined later that is should be established as. a commission they can' do so then. <br />Councilmember Kurak inquired if the development agreement indicated that a Town Center <br />Review Board needed to be established within 90 days of the signing of the development <br />agreement. City Administrator Norman replied yes, but staff has informed Ramsey Town <br />Center, LLC that it will take longer than the 90 days, but they are working on it. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Strommen, Kin'ak, <br />Elvig, Pearson, and Zimmerman.
