CC Regular Session 4. 6. <br />Meeting Date: 09/23/2014 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #14-09-196 Approving a Development Agreement for the Plat of Rabbit Meadows; Case of Eric <br />and Karla Thomsen <br />Purpose/Background: <br />On August 26, 2014, City Council adopted Resolution #14-08-166 granting Final Plat approval to Eric and Karla <br />Thomsen for Rabbit Meadows contingent upon compliance with the Staff Review Letter and execution of a <br />Development Agreement. At the time of Final Plat approval, the Applicant did not have their engineer's estimated <br />costs for the Required Improvements completed and thus, only a draft Development Agreement was included with <br />that case. <br />City Code outlines all required improvements associated with any proposed subdivision. The purpose of the <br />Development Agreement is to clearly identify what party is responsible for installation of the Required <br />Improvements contractually obligates that party to complete the work in accordance with City Code and the <br />approved plans. <br />The Applicant continues to work through necessary plan revisions as outlined in the Staff Review Letter and has <br />now provided their engineer's estimated cost of the Required Improvements related to the project. With this <br />information, the Development Agreement has been updated and is now ready for City Council approval. <br />Notification: <br />Notification is not required for approval of a Development Agreement. <br />Funding Source: <br />All costs associated with the request are the responsibility of the Applicant. <br />Recommendation: <br />City Staff recommends adopting Resolution # 14-09-196 approving the Development Agreement for the Plat of <br />Rabbit Meadows. <br />Action: <br />Motion to adopt Resolution #14-09-196 approving the Development Agreement for the Plat of Rabbit Meadows. <br />Site Location Map <br />Final Plat <br />9.5.14 Plans <br />Develoment Agreement <br />Resolution #14-09-196 <br />Attachments <br />
