resolve a legal dispute between Anoka and Ramsey regarding that <br />property. Waste Management has agreed to have the parent <br />corporation provide it's financial strength so that Ramsey will <br />not be liable in the event that it is ever brought to task for <br />it's involvement with the landfill, either as owner or supervisor <br />of that landfill. The parent corporation will provide assurances <br />that if there are problems requiring remedial action, the money <br />will be there to take care of those problems. As a condition to <br />that contract, Waste Management has asked for a Conditional Use <br />Permit to operate the landfill both in the South and in the <br />environmental improvement to the North. <br /> <br />Mr. Moersfelder stated that any final determination regarding <br />Site P is not likely to be made for another year and a half; <br />in the meantime, the current landfill is reaching capacity and <br />because of leadtime necessary to continue disposal of waste <br />uninterrupted, the conditional use permit is part of the negotiations <br />leading into the landfill contract. <br /> <br />Mr. Moersfelder stated that the conditional use permit addresses <br />three factors: <br /> <br />There is a possibility no new site will be selected under <br />Waste Management Act and some provision must be made for <br />future landfilling in this community.. <br /> <br />There is a possibility that Site P will be selected, but <br />on a timetable as such that there may be months or more <br />passing after the present capacity is finished and Site <br />P can come on line. <br /> <br />Since the time that this landfill was sited in 1967, there <br />have arisen certain environmental concerns that-Waste <br />Management feels can be alleviated in order to provide <br />Ramsey protection and provide Waste Management assurance <br />that remedial action guarantees will not have to be called <br />upon by the parent corporation. <br /> <br />Mr. Don Otter stated that Waste Management took over this facility <br />in the early 1970's. The planned end use of this site as a park <br />were promises of past owners of the site. Problems associated <br />with that type of end use could be deterioration of final cover, <br />infiltration and environmental problems. Waste Management, as <br />owners of the site, when doc~ments are signed, is proposing that <br />the end use be open space. Other uses could be evaluated by <br />Council and County. <br /> <br />Mr. Roger Berres stated that he understands the concerns of the <br />citizens and requested that they keep an open mind and process <br />the information presented tonight. Mr. Berres stated that in <br />terms of landscaping and vegetation, he is not proud of the <br />present development but Waste Management has been operating under <br />a lease. Landfill is a very passive use of land; landfills make <br />no demands on schools, fire protection and police protection and <br />it pays real estate taxes. Those residents adjacent to this site, <br />in years to come, will be beneficiaries of a tremendous open space. <br /> <br />Council/P & Z <br />Public Hearing <br /> Page 4 of 23 <br /> <br /> <br />
