Councilmember Schlueter inquired if Waste Management can make a <br />deal with Anoka for their south 80 if Ramsey City Council <br />disapproves the conditional use permit? <br /> <br />Mr. Goodrich replied that if Ramsey disapproves, Waste Management <br />probably would not go forward with purchasing the existing site and <br />Ramsey's interest would continue in the entire 160 acres and we <br />would be status quo with regards to Anoka and the landfill lawsuit. <br />If Ramsey allows a permit for the Westphal property, Ramsey <br />receives 20% of the gross revenues for all fill put there. If <br />Council deletes the Westphal property from the permit, there <br />would have to be an amendment to the contract. If Council denies <br />the conditional use permit entirely, the Westphal property is out. <br /> <br />Mayor Gamec inquired if denial of the conditional use permit pulls <br />the Westphal property out for sure? <br /> <br />Mr. Goodrich replied that Mayor Gamec's previous statement is <br />correct. Deleting references to Westphal property from the <br />proposed contract would make sure there is nothing which shows <br />that the Council is considering inclusion of the Westphal <br />property. Maybe Council even wants the record to show you are <br />not advocating the Westphal property issue either way. <br /> <br />Councilmember Van Wagner stated that she had no problem with the <br />proposed document until Westphal property was included; could <br />approve of this contract if all references to Westphal property <br />were deleted. <br /> <br />Mr. Moersfelder stated that in the course of negotiations of <br />this agreement, one of the items that was a continuing concern to <br />Mr. Lefevre, Mr. Goodrich and Mayor Gamec, was the concern of <br />protecting Ramsey from liabilities from the current site and any <br />additional site and that the parent corporation of Waste <br />Management is on board in case anything goes wrong. One of the <br />issues that came up was remedial action in connection with the <br />old site. Waste Management went back to the drawing board to <br />provide a remedial action guarantee to Ramsey and protect itself <br />in some fashion in giving that guarantee. At that point, Waste <br />Management came up with additional fill on the current operation, <br />liner under that additional fill and a collection station on the <br />Westphal property; that is the process by which the Westphal <br />property was included. Waste Management is in the process of <br />closing a similar agreement with Anoka; one of the conditions <br />to their closing is that Waste Management will receive a <br />conditional use permit to do environmental development on <br />Westphal property and additional capacity on the piece south of <br />the existing landfill. If that property is an issue, Waste <br />Management can forget it or go forward. Waste Management's <br />condition in paragraph 6.b is that we will have some assurance <br />from Ramsey that if we have permits to go forward, Council will <br />work with us on developing it. Including the Wesphal property <br />is not something you are committing yourselves to tonight; it <br />is not impediment to signing a document tonight. <br /> <br />Councilmember Sorteberg stated that Council's feeling might be <br />different after they have seen Waste Management's presentation <br />and the related public hearing. <br /> <br /> C/June 12, 1984 <br /> Page 7 of 9 <br /> <br /> <br />
