Councilmember Schlueter stated that she does not have that much <br />of a problem with leaving the Westphal property in the proposed <br />contract for now. <br /> <br />Mayor Gamec stated that his understanding of the situation is <br />that if the conditional use permit is denied, Ramsey Council is <br />not agreeing,'.by the proposed contract, to expand the landfill. <br /> <br />Mr. Moersfelder stated that Mayor Gamec's statement is correct. <br /> <br />Mr. Goodrich stated that Ramsey still has to issue a conditional <br />use permit for landfill expansion. The contract does not obligate <br />Ramsey to landfill expansion. Only the conditional use permit <br />can do that. <br /> <br />Mr. Otter stated that Mr. Goodrich's statement is correct. <br /> <br />Mr. Moersfelder stated that Mr. Goodrich's statement is correct. <br /> <br />Councilmember Schlueter stated that the term 'shall' in the <br />contract gives her an uncomfortable feeling. 'Shall' in the <br />dictionary means 'obliged' <br /> <br />Mr. Goodrich stated that the proposed contract is based on <br />contingencies and the term 'shall' does not come into play <br />unless the contingencies are fulfilled. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Sorteberg to <br />adopt Resolution #84-109 regarding the proposed contract for the <br />sale of the City's interest in the existing landfill site and <br />80 acres immediately south. <br /> <br />Further Discussion: Mr. Goodrich stated that if Council passes <br />this resolution, Ramsey has given up: <br /> <br />Ail it's rights on the existing site in return for 10% <br />of the gross and $150,000. <br /> <br />2. Ail it's rights on the 70 acres to the south. <br /> <br />Mayor Gamec called for a roll call vote: <br /> <br />Councilmember Schlueter - Naye <br />Councilmember Reimann - Aye <br />Mayo= Game~ - Aye <br />Councilmember Van Wagner - Naye <br />Councilmember Sorteberg - Aye <br /> <br />Motion carried. <br /> <br />MAYOR/COUNCIL INPUT <br /> <br />Central Park Discussion - Council noted receiving price quotes <br />on bleachers for Central Park and Council consensus is that <br />bleachers are not a top priority item at this time. <br /> <br />C/June 12, 1984 <br />Page 8 of 9 <br /> <br /> <br />
