E. Fe~.eral Fair Labor Standards Act..-

Mr. Goodrich stated that in February, 1984 the Supreme Court found
that under the Federal Fair Labor Standards, it is illegal for
cities to give comp time. If a city has employees working over 40
hours, the city must pay that employee time and a half; employees
can no longer have comp time and overtime pay must be paid for any-
thing over 40 hours. ~he County is strongly encouraging that all
~mployees use up retroactive comp time as soon as possible. Mr.
Goodrich recommended that the City implement this policy effective
with the next pay period.

Motion by Councilmenber Reimann and seconded by Mayor Hei~nan to
recognize the Supreme Court's interpretation of the Federal Fair
Labor Standards Act and to initiate immediately the incorporation
of the Federal Fair Labor Standards Act into City Ordinance;
further, to direct the Personnel Committee to review what
appropriate personnel policy changes may be necessary with a
preliminary recommendation to be made at the August 27 Council
meeting and a final recommendation to be made at the September
Council meeting.

Further Discussion: Councilm~mber Reimann stated that this 40 hour
policy should apply to all City employees and all retroactive comp
time should be used up within one year's time.

Motion carried. Voting Yes: Mayor Heitman, Councilmembers Cox,
Sorteberg, Schlueter and Reimann. Voting No: None.

F. Placing. City Staf. f And Councilme~bers In Difficult
Situations -

Mr. Schnelle cautioned Council against arbitrarily granting
variances to City ordinances without going through proper
procedures, i.e., findings of fact, etc.

G. Staffing-

Mr. Schnelle stated that this item has been temporarily tabled.

H. Setting..Special C~..uncil Meeting To Meet With AFSCME Council.
~14 Regarding Labo..r. Contract-

Councilm~nber Reimann stated that the Personnel Committee is
recommending that the proper procedure would be for Staff to meet
with AFS(1ME and report back to Council.

Councilm~mber Cox suggested that it would be appropriate for a
member of the Personnel Committee to sit in on this meeting with

Councilm~nber Reimann stated that the meetings are open.

August 13, 1985
