Inc. And MPCA:.

Councilmember Cox stated that there is a very critical matter existing between
MPCA and Waltek. Councilm~nber COx stated that prior to the present operator
at the landfill, he and Mr. Schnelle noticed ponding areas at the landfill;
these ponding areas lead to contamination; and at this time, PCA was putting
their stamp of approval to the operation of the landfill; he and Mr. Schnelle
worked to see that proper sloping was attained at the landfill. Councilm~ber
Cox stated that Waltek has been cooperating with the County to utilize the
methane gas at the landfill to generate electricity. At the same time Waltek
is working to solve problems created by PCA, PCA is giving Waltek the choice of
a 1st, 2nd or 3rd class violation and fine for improper storage of freon and
caustics. ~his improper storage has not created any contamination but has the
potential to. The cost of a 3rd class fine is $25,000. North Dakota is working
very agressively to get Mr. Walters of Waltek to relocate in North Dakota by
offering to move his operation and key personnel and sell him a facility for
$1.00. Councilmenber Cox stated that the City Attorney should contact PCA and
request that they give Waltek 30 days to get into compliance; why fine somebody
$25,000 that is already cooperating with the County and considering expnding
and hiring 10 more people. Minnesota's Governor is running all over the worlk
trying to get more business for Minnesota and at the same time our existing
businesses are being chased away.

City Attorney Goodrich stated that even though Waltek provides the City with
tax base and jobs, it would be inappropriate for the City Attorney to get
involved and set a precedent; Mr. Walters should have his own attorney review
this situation.

August 13, 1985
