yor Hei.~an stated that until Council has the opportunity to review all the
nformatlon, it just might be that PCA is doing Ramsey a favor.

Councilmember Cox stated that he is telling Council what the information is;
PCA is fining an individual who has not contaminated, but the potential is
there.

Motion by Councilm~mber Sorteberg and seconded by Councilnmmber Cox directing
City Staff to request that the Anoka County Environmental Health Committee
gather all information regarding this situation between Waltek and PCA and
report to the Ramsey City Council at their meeting scheduled for August 27,
1985.

Motion carried. Voting Yes: Mayor Heitman, Councilm~mbers Sorteberg, Cox,
Reimann and Schlueter. Voting No: None.

Case #12: Request For A Temporary_ Conditional Use Permit; Cas~.Of Mr, No.rm
Holm:

Mr. Goodrich stated that there is a piece of property at the intersection of
County Roads #116 and #56, just south of Tom 5hunb, where presently a mining
and excavation project is going on. Ramsey has ordinances stating that such an
operation requires a conditional use permit; Mr. Norm Holm o~ns the property
and he does not have a permit for the operation. Mr. Norm Holm contends that
he is a non-conforming use because of previous similar operations on this
property. Mr. Goodrich stated that he has verified that similar operations
have been carried on at this property prior to 1973; Ramsey township had some
ordinances in effect relating to this type of activity but it has not been
determined whether or not they were properly published. A temporary
restraining order has been placed on the operation. Not withstanding all this,
Mr. Holm has agreed to apply for a conditional use permit. Mr. Goodrich
reviewed the proposed resolution with Council and suggested that Council
consider granting Mr. Holm a temporary conditional use permit, which does not
require a public hearing, contingent upon Mr. Holm entering into a development
agreement requiring that the hours of operation be limited, a grading and
restoration plan be provided, certain screening on the north be provided, dust
control be maintained (which, to Mr. Holm's credit, is already being done), and
an escrow be provided to insure that screening and restoration will be
accomplished. Mr. Goodrich stated that to this point, no citizens have called
to complain about the operation but he has noticed some gravel accumulation on
Cty. Rd. #56 which Mr. Holm has agreed to take care of.

Mr. Holm presented a sketch plan for Council revi~. Mr. Holm stated that he
had ass~ed the activity was grandfathered in on the property and he would be
willing to test it in Court; in the spirit of cooperation he is willing to
apply for a temporary conditional use permit. Mr. Holm stated that he doesn't
believe screening on the north is necessary as there is no need for the
operation to get any closer than 200' frown the north property line.

Mr. Goodrich stated that the City required a $7500 bond and a $1000 cash
deposit to administer the permit in Mr. Bud Sauter's case.

Mr. Holm stated that he is willing to post a bond but does not see the
August 13, 1985
