Councilmember Cox pointed out that Mr. Ness can build a 24' x 26' accessory <br />building and his truck should fit in that building. <br /> <br />Mr. Ness stated that his request before the Board of Adjustment is for a <br />building 6' larger than what oode allows; he needs room to store materials <br />along with the truck. <br /> <br />Mayor Heitman stated that the rules have been in place~~.,e time. ~ <br /> <br />Mrs. Ness stated that in April, before they purchased the property, they were <br />told by the B~ilding Inspector that if they wanted to operate a business from <br />their hcme~ all they had to do was apply for a conditional use permit and it <br />would be ~anted. Mrs. Ness stated that the hc~e improvement business is their <br />livelihood. Mrs. Ness stated that she and her husband have improved the <br />property considerably since they purchased it and the City was being grossly <br />unfair in changing the findings of fact. Mrs. Ness stated that she and her <br />husband are trying to take care of their needs legally while neighbors are <br />violating City codes; that she and her husband could have just built the <br />garage. Mrs. Ness stated that approving the conditional use permit and <br />approving the size building they need to store their equipment will improve the <br />looks of the property and it will not be a hazard to anybody in any way. Mrs. <br />Ness requested that Council reconsider the request. <br /> <br />councilme~ber cox stated that he is not willing to reconsider; 24' x 26' should <br />suffice with some additional height to the building; Ramsey's business sector <br />is being taxed 4 to 5 times more than the residential areas and Council should <br />not be encouraging business growth in R-1 districts. <br /> <br />Mayor Heitman and Councilm~mbers Reimann and Schlueter stated that they will <br />not reconsider the request. <br /> <br />Mayor Heitman stated that enforcement of these ordinances is on the Council <br />agenda for discussion this evening; if the City is going to be consistent, we <br />have to start enforcing the ordinances. <br /> <br />Mrs. Ness stated that the rules are being enforced after she and her husband <br />were misled and made application. Mrs. Ness inquired as to how she can appeal <br />Council' s ~ecision. <br /> <br />Mayor Heitman stated that she could get that information fr~ Mr. Goodrich. <br /> <br />Tax Inorement Financing= Adoption Of Dev~lo~ument Pro,_ram For Develo_~ment <br />District Ne. 1 And T~e Tax Increment Financina Plan For Tax Increme41t <br />Financina Distrigt No. 1.' - <br /> <br />Ms. Arlin Waelti was present. <br /> <br />Ms. Waelti spoke to Council's concern regarding whether tax increment generated <br />from a housing area could be used in an industrial area and stated that it can <br />be done b~t statutorily the City has to have a 'but for' benefit. Ms. Waelti <br />stated that prc~ect areas do not have to be contiguous and tax incr~ents frc~ <br />one district can be spent anywhere in the project area.
