process. ~he legal advice to the County was that if the request were to be <br />denied, it would give Waste Management a couple of recourses: 1. They would <br />be entitled to pursue several hundred thousand dollars in compensation; 2. They <br />could take the County to court and it would be the County because the County <br />would be denying the lifting of development limitations as Metro Council cannot <br />overrule the County and Waste Management would win. The County did vote to <br />all(~ Waste Management to mine 247,000 cubic yards of subject to Waste <br />Management getting Ramsey's approval for r~cessary permits. Co~missioner Haas <br />stated that in defense of her vote today, she doesn't think taking sc~ebody to <br />court is a very wise expenditure of tax dollars if there is legal advice saying <br />'it's no use'. County C/x~missioner Haas stated that nobody from Ramsey was <br />present at a Metro Council meeting after she had specifically requested that <br />Metro Council invite Ramsey. At that meeting, Waste Management of Minnesota, <br />Inc. talked about changing the contours of the landfill with 1.2 million <br />cubic yards of tra.~h; the City of Ramsey and County Cc~missioner Haas' office <br />will be receiving a large amount of information addressing remedial action. <br /> <br />Mr. Schnelle inquired as to why the County doesn't assist Ramsey in it's <br />proposed legislation action to protect hosting cities. Ramsay is a very busy <br />city and there is no way we can make it to all these x~etings. <br /> <br />County (~issioner Haas stated that the County would look at that proposed <br />legislation and support Ramsey; added that she is not here to chastise Ramsey <br />for not attending the meetings. <br /> <br />Mayor Heitman irguired if the County's approval of lifting the develof~ent <br />limitations was subject to Ramsey's approval. <br /> <br />County G0~issioner Haas stated that it was not; the lifting of the development <br />limitations was the County's responsibility but Ramsey might have certain <br />permits and requirements in regards to mining; one of the conditions of the <br />County's approval was that Waste Management obtain the necessary licenses or <br /> <br />Councilm~mber Cox stated that the July 29 Council minutes sh~ that Mr. <br />Schnelle made it known that the Enviror~nental Services Co~ittee was having a <br />meeting and this Council directed City Staff make it known that Ramsey doesn't <br />want any goverr~ent body doing anything to encourage landfill expansion. <br /> <br />County Co~lssloh~ Haas sta~ea-rna~ s~e'~as n~ been presented with a ~{~%-~'~ <br />resolution.
