accessory structure size ordinance and initiate the necessary steps to
implement those modifications.

Further Discussion: Council~ber Schlueter stated that at a previous meeting
she made it known to Mr. Johnson that she made a mistake in the voting; that
she wanted the matter cleared up that night but the Mayor took that opportunity
away frc~ her by tabling the case. Councilm~ber Schlueter also noted that
Council unanimously denied Mr. Ness; presume that this motion does not include
reversing the action in Mr. Ness' case. Mayor Heitman stated that his motion
is on the premise that in order to get to a new and clean baseline, he will go
against his original thoughts. Mayor Heitman stated that his ultimate goal is
to get out of the process of public hearings on requests for variances to
structure size; the ordinance states the size limits, City Staff can enforce
that ordinance at the City Hall counter and citizens can save themselves $90.
Councilmember Schlueter stated that she will not give a blanket approval to the
board of adjustment variances that were tabled. Councilr~a~ber COx stated that
he disagrees with the Attorney's opinion; the ordinance was adopted with the
intent that people have the right to go beyond the City Staff level and come
before the elected officials with their request; it appears that we are trying
to take that right away. Council~a~ber Sorteberg suggested an adjustment to
the square footage allowed could alleviate the need for board of adjustment
public hearings and meetings. Councilm~mber Sorteberg stated that Council
should meet with Planning and Zoning on October 1 and resolve the ordinance and
tabled requests for variance issues at the October 8 Council meeting; also not
in favor of a blanket decision. Council~ber Reimann stated that he is not in
favor of a blanket decision. Council~ember COx stated that another concern is
that people understand that the $90 board of adjustment fee does not guarantee
an approval to the request.

Motion failed. Voting Yes: None. Voting No: Mayor Heitman, Council~bers
Sorteberg, Gox, Reimann and Schlueter.

Motion by Councilmember Sorteberg and seconded by Councilmember Schlueter to
schedule a special Council meeting for 6:30 p.m. on October 1 to meet with
Planning and Zoning regarding the accessory structure size ordinance; further,
that Council take action on the ordinance and the tabled requests for variances
at the special Council meeting scheduled for October 8.

Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox,
Reimann and Schlueter.
