t~mporary ~onditional use permits are satisfied and those same criteria do not <br />apply as specifically in a special use permit; the bonus is that the use would <br />be tied to the property owner rather than to the property itself. <br /> <br />Mr. Otter inquired if the City is considering requesting that all other <br />excavation permits in Ramsey be by special use permit. <br /> <br />Mayor Heitman replied that the special use permit is a part of the proposed <br />recodification and there is a concurrence on the part of Council that <br />recodification will be approved. <br /> <br />Mr. Otter inquired if he would have to go through a hearing process again if he <br />changed his request to a special use permit. <br /> <br />Mr. Goodrich stated that the public hearing cannot be waived. <br /> <br />Mr. Otter stated that if waiting until recodification is adopted and applying <br />for a special use permit means he has to go through the hearing process again, <br />he prefers that Council take action on his existing request for a temporary <br />conditional use permit. If the t~mporary conditional use permit is denied he <br />will apply for a special use permit. <br /> <br />Mr. Goodrich stated that he believes Mr. Otter would agree to language being <br />written into the permit agreement that would tie the use to the owener rather <br />than the property. <br /> <br />Councilm~mber $chlueter noted that she voted negatively to the findings of <br />fact and temporary conditional use permit and is obligated to vote 'no' to the <br />permit agreement. <br /> <br />Mr. Goodrich stated that there has been past discussions regarding trespassers <br />accessing the subject property from the north to dtm~p garbage and the fact that <br />the applicant should have that access restricted; after some research it has <br />been determined that the area of property in question does not belong to Waste <br />Management. <br /> <br />Motion by Councilmember COx and seconded by Councilmember Sorteberg to adopt <br />the temporary conditional use permit agreement for Waste Management of <br />Minnesota, Inc. as reviewed at this Council meeting of November 26, 1985 and to <br />authorize the Mayor and Acting City Administrator/Clerk to execute the same <br />upon payment by the applicant of the temporary conditional use permit fees. <br /> <br />Further Discussion: Mayor Heitman inquired as to what assurance the City has <br />that final grade elevations will be maintained as it is stated they will be <br />maintained. Mr. Otter replied stated that annual topography maps are prepared <br />and they will be submitted to the City for review. Mayor Heitman inquired if <br />compaction after excavation will match the current compaction levels. Mr. <br />Otter replied that the topsoil will be looser but within a short period of time <br />compaction will reach it's original state.
