R~q,~-mt P~r..C~nditional Haa P~rmit T~ Or, rata An Automoh~lo ~ale~ And <br /> R~_r~air.,Service In A UMB District: Case ~f Mr. Gerald Root: <br /> <br />Mr. Wes Alden, future manager of the automobile sales and repair service, and <br />Ms. Joan Dickenson, realtor, were present. <br /> <br />Councilmember COx inquired as to the zoning issue brought up at the December 3 <br />Planning and Zoning meeting regarding the subject property. <br /> <br />Mr. Goodrich replied that U~-2 zoning has been done away with and City Staff <br />agrees that the subject property is UMB by default. <br /> <br />Motion by Councilmmber COx and seconded by Councilmember Reimann to adopt <br />Findings of Fact 0129 for Mr. Gerald Root's request for a conditional use <br />permit. (Please refer to findings of fact file for Findings of Fact 0129). <br /> <br />Further Discussion: Councilm~mber Schlueter stated that Criteria for Approval, <br />Item 98a-h, is negative against approval. Mr. Goodrich replied that Item #8 is <br />under Criteria for Approval; it is not saying that item 8a-h is a finding. <br /> <br />Motion carried. Voting Yes: Councilmembers Sorteberg, Cox and Reimann. <br />Voting No: Mayor Heitman and Councilmember Schlueter. <br /> <br />Mr. Alden stated that he has reviewed the conditional use permit agreement and <br />he has no problem with it. <br /> <br />Councilmember Cox noted that the hours of operation are limited to 5:00 p.m. on <br />Fridays and Saturdays. <br /> <br />Mr. Alden replied that most car lots close at 5:00 p.m. on Fridays and <br />Saturdays and that it has been the normal business routine for the firm owning <br />this subject car lot. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Reimann to approve <br />Mr. Gerald Root's request for a conditional use permit to operate an automobile <br />sales and repair service in a UMB District. Further, that hours of operation <br />will be amended to allow for an 8:00 p.m. closing time on Fridays, if the <br />applicant so desires. <br /> <br />Motion carried.
