Council unanimously consented to dispense with the reading of the resolution. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Reimann to adopt <br />Resolution #85-6 approving partial payment no. 4 for Arcon Construction in the <br />amount of $70,829.05. (Please refer to resolution file for Resolution #85-6). <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />b) Receiving Feasibility Report For ~ne Battenberg Drainage Problem - <br /> <br />Inquired as to why the public hearing date can't be set until February 26; are <br />not the benefitted property owners identified in the feasibility report. <br /> <br />Mr. Berg that the resolution listing all the names of the property owners has <br />not yet been prepared. <br /> <br />Mr. Schnelle stated that City Charter requires that proposed storm drainage <br />improvements be published in the City Newsletter and no action taken until 60 <br />days after the public hearing; this process will take about 90 days. <br /> <br />Mr. Raatikka stated that DNR allows the installation of outlets to lower the <br />water level below the ordinary high; this is not an ultimate solution. <br /> <br />Mr. Schnelle stated that at the time this area was platted, it was a high and <br />dry area; this wetland did not exist. It is a situation where something got <br />out of hand; maybe part of the wetland should exist, but not the way DNR wants <br />it to exist. Mr. Schnelle stated that this is an issue the legislators should <br />be brought into; this is a government created problem and government should <br />uncreate it. City Council and City Staff should have spent more time and <br />money researching this when watershed areas were established and DNR should <br />view this area and see what they have done. Mr. Schnelle stated that the City <br />would not have allowed platting of this area if such a wetland had existed. <br /> <br />Councilmember COx stated that the situation is much worse than what Mr. <br />Schnelle is saying; all kinds of controls are put on us by all levels of <br />government and it costs money to fight them. <br /> <br />Mr. Jim Battenberg - 7471 150th Lane - ~hanked Council and Staff for what they <br />have done so far. Mr. Battenberg stated that he would like something in <br />writing from the City stating that platting would never have been allowed if <br />such a wetland existed in this area and in it's present condition, that area <br />would not be approved for platting today.
