Reimann and Schlueter. Voting No: None.

Council unanimously consented to dispense with the reading of the resolution.

Motion by Councilmember Cox and seconded by Councilmember Sorteberg to adopt
Resolution #85-10 receiving the feasibility report and setting a public
hearing date of Tuesday, April 9, 1985 for River's Bend Second Addition.
(Please refer to resolution file for Resolution #85-10).

Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox,
Reimann and Schlueter. Voting NO: None.

Councilmember Cox inquired as to why there is such a long delay in conducting
the public hearing.

Mr. Berg replied that the City Charter requires that the public hearing notice
be published in the City Newsletter.

Councilmember COx stated that this is a situation where delays are costing a
lot of money. Councilmember COx referred to the front page article of
January, 1985 Ramsey Resident, where members of CounCil profess to encourage
economic development and stated now we have the opportunity for that
development and we place all kinds of impositions on the developer.

City Attorney Goodrich stated that an interim newsletter can be published with
the hearing notice; the Charter does not limit the number of newsletters to
six.

Mayor Heitman stated that fast does not necessarily mean good, but this is one
of the reasons he inquired earlier about increasing the frequency of the
newsletter.

Councilmember COx inquired why we should continue to spend more money instead
of correcting the problem.

Mayor Heitman inquired if the Charter specified whether or not failure to
publish a hearing notice in the newsletter negates it.

Mr. Berg replied that such a statement is not included in this section of the
charter.

City Attorney Goodrich stated that he doesn't think the City can abide with
the charter and conscientously not publish the hearing notice in the
newsletter.

Councilmember COx stated that he thinks this time frame feature was included
in the charter as a protection in cases where there is a lot of residents
potentially affected; don't think the Charter Commission intended for that
feature to affect cases like this and Mr. Battenberg's.

Mayor Heitman stated that he would like the Charter Commission to come up with
an alternative to carry the City through these types of situations.

January 22, 1985
