Flintwood II development, the collapsed drainage pipes were found. There were <br />no City records on this drainage system and we found out that it was a County <br />project. ~he City did not know ~out this drainage system from the early <br />1900's until 1979. <br /> <br />Councilmember Cox stated that a lot of situations like this exist; there are a <br />lot of things controlled by City Council and Staff that are preempted by laws <br />that precede us. Councilmember Cox sited Rodeo Hills as an example of where <br />the City determined the area unbuildable and the County overruled and allowed <br />for development with special septic systems,~n~~' places where every <br />spring there is 6-10" of standing water. DNR is approving permits along the <br />river where the City said 'no'. ~ t~,~ ~.~ ~'~-%~ <br /> <br />Bill Hurney - 14140 Junkite - Don't those one or two residents having drainage <br />problems have any legal recourse available to them towards the developer of <br />their properties. <br /> <br />Mayor Heitman stated that this point could be checked. <br /> <br />John Lichter - Our drainage is getting out O.K.; we don't need a 48" pipe to <br />the Rum River; the whole reason for the storm drainage proposal is the PUD <br />development and the potential for develounent to the north and west. If the <br />City approves this storm drainage project, we will get a petition to stop the <br />project and the developer's plans will be delayed for one year. City should <br />go with plan Alternate B outlined in the feasibility study. <br /> <br />John Anderson - Agree that as a City develops, drainage problems arise. What <br />has been proposed seems to be fair solution but the people of Flintwood Hills <br />are concerned with the cost burden; is there any way the cost can be absolved <br />by the City as a whole because the City made the mistake of allowing building <br />to occur in low lands. <br /> <br />Mr. Berg replied that everybody in the City, at some point in time, will face <br />what Flint~ood and Ramsey Terrace are facing now. Everybody will be included <br />in a drainage district and whether or not that district ever has a problem is <br />the question. <br /> <br />Mayor Heitman stated that he would not be in favor of the City picking up the <br />cost. <br /> <br />Mr. Raudio stated that the people should understand that water districts are <br />not unique to Ramsey; this exists in every community in the Country. <br /> <br />Councilmember COx stated that the citizens should weigh all sides of the issue <br />and consider the costs before signing any petition because this is their baby <br />and they are stuck with it. Councilmember COx stated that he too, will fall <br />into a water district; this is just not unique to residents of Flintwood and <br />Ramsey Terrace; it just happens to be that these particular residents are the <br />first to be confronted with the storm sewer issue. ~hese people may get <br />enough petition signatures to stop the project now but it might end up costing <br />them a lot more to solve the problem in the future. <br /> <br />Tony Simborski - ~he developer of the PUD should be responsible for upstream <br /> January 29, 1985 <br /> <br />Page 7 of 9 <br /> <br /> <br />
