I. Consideration Of 167th Avenue NW:

City Engineer Raatikka stated that he has reviewed the feasibility of upgrading
167th Avenue ~ west of Nowthen Blvd. N~ and noted that because the City's
share is more than 20% of the project cost, the Charter allows the opportunity
for 50% of the voters in the last election to petition to cease project
consideration.

Motion by Mayor Heitman and seconded by Councilmember Sorteberg to table
further consideration of this case until the regular Council meeting scheduled
for June 25, 1985 to allow City Attorney Goodrich and Councilmember Cox time to
contact the Hunt family in order to determine whether or not they are inclined
to petition against the project.

Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox,
Reimann and Schlueter. Voting No: None.

A. Adoption Of Pro_Dosed Environmental Protection Ordinance %8~-2~

Councilmember Schlueter stated that she is opposed to the proposed ordinance,
specifically Page 1, Item 170.0112A (b), 3rd Sentence - based on the fact that
she orignally agreed with reclassification of Sunfish Lake, but after further
discussions with previous Councilm~mber Sue Van Wagner, she desired to rescind
her decision on reclassification of Sunfish Lake. Councilmember Schlueter
stated that she doesn't recall being able to be involved in not reclassify
Sunfish Lake.

Mr. Raatikka stated that a public hearing was held in February, prior to the
ordinance coming to Council and not comments were made at the public hearing.

Councilmember Schlueter stated that if Council is going to adopt this ordinance
tonight, she would hope that it is going to be enforced; there is clear
cutting, loss of water, etc. happening now that is not being dealth with
properly; Mr. Kurak clear cutted his back yard.

Mr. Schnelle stated that the City cannot enforce an ordinance unless there is
an ordinance.

Councilmember Schlueter stated that the City did a good job of enforcing with
Mr. Potter.

Mr. Schnelle stated that Mr. Potter's property falls under Wild and Scenic
River Ordinance jurisdiction.

Motion by Councilm~nber Sorteberg and seconded by Mayor Heitman to dispense
with the reading of proposed Ordinance 985-2 entitled the Environmental
Protection Ordinance.

Motion failed. (Motion to dispense with the reading of an ordinance must be by
a unanimous vote in order to carry.) Voting Yes: Mayor Heitman,
May 28, 1985
