Mr. Raatikka stated that Council has established the storm sewer taxing <br />districts; at the next regular meeting Council will address how they want <br />to handle each individual subdivision improvements; staff will be <br />recommending that Council make improvements in existing areas under the <br />authority of the storm sewer taxing district. <br /> <br />Mr. Raatikka proceeded to summarize the timetable for the proposed project <br />noting that plans and specs cannot be ordered until 60 days after tonight's <br />public hearing. That 60 days provides affected property c~ners the time to <br />sukmit a petition either favoring or opposing the project. If the project <br />is approved, construction could begin the end of June and the assessment <br />hearings would be in September. Property owners have 30 days from the date <br />of the assessment hearing to pay their assessments with no interest. If <br />the assessments are not paid within that 30 days, they will be added to <br />property taxes. <br /> <br />Mr. Hartley referred to Ms. Specht's earlier question regarding whether or <br />not these improvements can be levied against the entire Mississippi River <br />Storm Sewer District and stated that a draft policy will be presented to <br />Council on February 24 for their adoption that states that all costs <br />related to storm sewer improvements would be paid by the taxing district <br />with the exception of improvements necessary for developers to accomplish <br />in order to make their land developable. Mr. Hartley proceeded to explain <br />the city charter provisions for petitioning and stated that discussion of <br />this particular project was initiated by petition. Those favoring and <br />those opposing the project now have 60 days to submit a petition; those <br />that have the most number of properties represented on the petition after <br />the 60 day waiting period has expired will prevail. There will be no <br />action being taken on the project by Council until that 60 day waiting <br />period has expired. Mr. Hartley also noted that it is important for <br />property owners opposing the project to submit letters stating so; those <br />letters will serve as supporting documentation should the property owner <br />wish to appeal an assessment in district court. <br /> <br />Mayor Peimann stated that he has received letters from Gary Gorham and <br />Edward Wilberg favoring the project and Robert Alhlman and Bill Jordan <br />opposing the project. <br /> <br />Randy Matthies - 9121 Collins Drive - Suk~itted a letter to Council from <br />Dan Bertram of 9043 Collins Drive opposing the project. Mr. Matthies <br />stated that he will submit a letter from himself by the time this public <br />hearing adjourns. <br /> <br />Todd Soring - 9115 Collins Drive - Inquired if the petition process is the <br />deciding factor in whether a project is approved. <br /> <br />Mr. Hartley replied that the project can be discontinued if Council chooses <br />to do so for one reason or another; the petition signed by at least 50% of <br />the affected property owners will prevail. <br /> <br />Councilmember Cox informed the residents that they should take economic <br />aspects into consideration when deciding whether or not they are in favor <br />of the project. The city is currently experiencing a very low interest <br />rate and oil costs are down.
