Mr. Jo,eph Anderson, attorney for Paul Bertils, inquired if development of <br />Now and Then Estates can proceed if a 30' foot easement is provided to <br />access 167th. <br /> <br />Mr. Raatikka stated that he feels the developer can proceed. He also noted <br />that a 3rd party can keep a piece of property landlocked and demand an <br />unrealistic figure for access. Although 3 petitioners can stop <br />improvements to 167th which would include acquisition of property that <br />would provide access for Now and Then Estates~ ordinance also allows <br />Council the power to condemn property as necessary. <br /> <br />Councilmember Sorteberg urged Mr. Bertils to negotiate with the property <br />owner of that rod that is landlocking Now and Then Estates. <br /> <br />Mr. Anderson stated that Mr. Bertils only needs an easement across the rod <br />to access 167th; the owner of the rod of property wants to sell it all or <br />nothing. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca <br />encouraging a negotiation between Paul Bertils and owner of that rod of <br />property landlocking Now and Then Estates on the basis that the balance of <br />the property will be compensated for when acquistion for 167th improvements <br />begin. <br /> <br />Further Discussion: Merlin Hunt stated that people are already using the <br />access. Mr. Goodrich stated that cities generally have right to what is <br />being driven. Council directed Mr. Raatikka to review boundaries for 167th <br />and determine if the 16 foot rod in question is a part of 167th by use. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cox to adjourn <br />the special Council meeting. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson.
