meets the standards for topsoil; it is being used to grow crops on the <br />property; according to State building code, as long as the dirt is not <br />being stockpiled, it can be hauled in. <br /> <br />Mr. Goodrich stated that the City can provide Ms. Nasby with a copy of that <br />portion of the State Building Code. <br /> <br />Kitty Nasby - Stated that the conditional use permit states that there can <br />be excavation and grading to create a man-made lake; it doesn't say dirt <br />can be hauled in to create anything other than a lake; that dirt is not <br />being hauled in for the man-made lake. <br /> <br />Mr. Goodrich - Stated that importing material is a separate permit process <br />under the State Building Code. The developers did not apply for an import <br />permit at the time of the original conditional use permit because they did <br />not have the option to import at that time. At a later date and fairly <br />recently, the developers applied for and received an import permit. <br /> <br />Mike Nasby - Inquired why the import permit was granted if the City already <br />knew there was a problem with truck traffic? <br /> <br />Mr. Goodrich - Stated that the permit process doesn't address truck <br />traffic; the City can only deny the import permit if the material adversely <br />affects the land to which it is being brought on. <br /> <br />Jamie Havisto - 15151 Iguana - Stated that whenever something happens that <br />affects her, she never gets notified. She found out about this hearing <br />from her neighbors. Stated that the Armstrong crossing is not safe; on <br />Monday night the crossarms were not working. Stated she doesn't want the <br />trucks using 153rd. Something needs to be done and everyone should be <br />notified; this is not a fair hearing. <br /> <br />Mr. Hartley - Stated that hearing notices were mailed to all affected <br />properties; names and addresses were derived from tax statements for <br />Whispering Pines 1, 2 and 3, another subdivision to the south and all <br />properties in Section 20. <br /> <br />Several other residents commented that they did not receive a hearing <br />notice. <br /> <br />Kitty Nasby- Stated that she saw the list of properties the City sent <br />hearing notices to and half the people in her neighborhood were not on that <br />list; the majority of the people that received the notices are located <br />further away from 153rd. <br /> <br />Marguerite Henke - Inquired if the conditional use permit is permanent and <br />if Council can revoke it; was there a public hearing regarding the creation <br />of a man-made lake? <br /> <br />Several citizens commented that they were not notified of a public hearing <br />regarding the creation of the lake. <br /> <br />Mr. Hartley - Stated that there was a public hearing conducted on the <br /> City Council Public Hearing/August 19, 1987 <br /> <br />Page 7 of 8 <br /> <br /> <br />
