Mr. Hartley - Stated that there is a great deal of history suggesting that <br />the Dayton crossing was public and not private. The problem the City faces <br />is one of how quickly can that crossing be re-established. If the City <br />petitions M~/DoT to enforce upon Burlington Northern that that crossing be <br />a permanent public crossing, the City will have to go through a hearing <br />process which can take a minimum of 6 months to two years. The concerns <br />that have been raised call for an immediate solution rather than a long <br />term lasting solution. It has been stated by MN/DoT and supported by <br />Burlington Northern, that if the City can reach an agreement with <br />Burlington Northern on any railroad crossing, then M~/DoT will make those <br />things happen as long as they are safe. If two parties disagree, there is <br />a long amd expenmive hearing process in which Burlington Northern will <br />oppose a~ long as they can. The City might be successful in having the <br />Dayton crossing re-established as a public crossing but it is sure to be <br />expensive. <br /> <br />Nancy 0hanlon- 15341 Nutria - Stated that trucks will ignore the Dayton <br />crossing because they are coming and going overloaded; they don't want to <br />be weighed and she knows from a near miss accident that the trucks are <br />speeding. Stated that last spring the school bus company altered it's <br />route to avoid dangers on 153rd. <br /> <br />Terry O'Connor - Stated that she doesn't want the buses to alter their <br />routes; she does not want her 5 year old walking 3 blocks out of her sight <br />to catch a bus when the child was supposed to be picked up right at the <br />corner. It is silly to have a 5 year old walk 3 blocks so the buses won't <br />interfere with Northfork truck traffic. <br /> <br />Mr. Hartley - Stated that the trucks have been asked to at least use Puma <br />in one direction; the problem faced is that it is physically impossible for <br />the trucks to turn into Puma from Hwy. #10 because there is not enough <br />room; they have been asked to use Puma to exit the area. The conditional <br />use permit the City has with North Fork and the people operating the <br />hauling in that area requires the trucks to use 153rd. Many of the trucks <br />choose to stay on 153rd because it is a better road. <br /> <br />Dan McGinnis - Inquired how other people would like it if there street were <br />taken away; he doesn't want Puma closed and he wants the trucks to keep off <br />of Puma. <br /> <br />Marguerite Henke - Stated that the truck hazard does not end at the <br />Armstrong crossing; noted that the truck traffic on Hwy. #10 will increase <br />even more when the trash burning plant is in operation in Elk River. <br /> <br />Kitty Nasby - Stated she hopes Council will come to a favorable decision <br />based on the comments of the majority of the people present at this <br />hearing. The conditional use permit granted to North Fork doesn't say <br />anything about hauling dirt in; was an EIS performed on the soils being <br />brought into that area? If Council can't come to a decision tonight, the <br />truck traffic should be stopped because the conditional use permit is <br />violated by the hauling in of dirt. <br /> <br />Mr. Raatikka - Stated that the dirt being hauled in has been tested; it <br /> City Council Public Hearing/August 19, 1987 <br /> <br />Page 6 of 8 <br /> <br /> <br />
