Case #1 Request for conditional use permit to extract aggregates in the I-1 <br /> <br />Industrial District; case of Barton Sand and Gravel Company: <br /> <br />Ms. Norris stated that Barton Sand and Gravel Company is requesting a condi- <br />tional use permit to extract ag§regates in the I-1 Industrial District over a <br />3-5 year period. The eastern portion of the property is marshy and contains a <br />wetland. The proposed plan shows access to the site from both County Road No. <br />116 and Ramsey Boulevard NW. The Planning and Zoning Commission recommended <br />approval of the request. <br /> <br />Mr. Gary Sauer, President of Barton Sand and Gravel Company, was present. In <br />response to Councilmember Cox's inquiry of whether the elevation of excavation <br />will be spelled out within the Development Agreement, Mr. Sauer replied that it <br />would be spelled out. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to approve <br />Barton Sand and Gravel Company's request for a conditional use permit to extract <br />aggregates. <br /> <br />Discussion ensued relative to items the Councilmembers wanted clarified. Mr. <br />Sauer made the following statements in response to the Council's inquiries. <br /> <br />Actual extraction will take 3-5 years and restoration could take as long <br />another 5 years. Mr. Sauer expressed agreement to a conditional use <br />permit of 5 years and if it becomes necessary, he will reapply when it <br />expires. <br /> <br />o Updating of the conditional use permit will be based on the airport <br /> qualifying. <br /> <br />o A 6' berm shall be constructed by the applicant on the western boundary of <br /> the site to act as a buffer zone to the west of the excavation area. <br /> <br />Months of operation will be from May to October. Although the requested <br />hours of operation are from 7:00 a.m. to 7:00 p.m. Monday through Satur- <br />day, it is expected that Saturdays will be on an occasional basis and the <br />hours are requested are to cover maximum operation which may be only 1 <br />month out of the entire year. <br /> <br />o Trucks will be running steadily during hours of operation. <br /> <br />Dust control will be an active concern and money is in an escrow account <br />that could be used for watering if excessive dust causes citizen <br />complaints. <br /> <br />After maximum elevation of excavation, the site will be filled back in <br />with a minimum of 5 feet of local soil and covered with a foot of top soil <br />which may be brought in. Also, some top soil may be brought in for <br />bermin§. Other than the stated top soil needs, no other materials will be <br />brought in from off site. <br /> <br />o A minimum grade of 870 feet above sea level will be adhered to and filled <br /> back with site material to a minimum of 875 feet above sea level. <br /> <br />City Council/August 25, 1987 <br /> Page 11 of 16 <br /> <br /> <br />
