Response The parcel in question is recommended to be acquired under the approved <br /> airport layout plan and, therefore, no building permit should be issued <br /> for the property. If zoning ordinance is adopted, people may press <br /> damages against the City. <br /> <br />Comment Duane Lundeen - part of my property lies in one zone and part in <br />another, what restrictions would apply. <br />Response After the first public hearing some allowances were made to bring <br /> approach surface into better alignment with property lines, but if a <br /> portion of his property still lies within B Zone, he would not be <br /> allowed to expand a structure within the zone. A structure that does <br /> not lie within the B Zone could be expanded as long as the setbacks are <br /> followed. <br /> <br />Comment Mr. Brad Jensen - wants more answers regarding sewer and water improve- <br /> ments and the ability to subdivide. <br />Response City Council will address. He is not within the B Zone and so <br /> subdividing is not a question dependent on airport zoning. <br /> <br />Comment Mr. Hamel - expressed concern relative to the south approach crossing <br /> power lines, Highway 10 and the railroad tracks. <br />Response The existing facilities have had an approach across these three <br /> features since 1972. Operations have occurred without an incident. <br /> The proposed improvements provide for adequate clearances over all <br /> traverseways. Obstructions within the approach areas are recommended <br /> to be removed, relocated or buried. <br /> <br />Comment Question in General: Will Highway 10, the railroad, and existing power- <br /> lines be an obstruction. <br />Response Do not see that there is any problem. With proposed changes, a margin <br /> of safety would probably be enhanced. <br /> <br />Comment Keith Sauer - comments relate primarily to the desirability of airport <br /> development rather than to airport zoning. <br />Response There is little to respond to other than referring Mr. Sauer to the <br /> Master Plan Study. <br /> <br />Comment Sharon Mager - expressed concern about legal matters raised by MC and <br /> WMMI and lawsuits resulting in extra costs to the City. Also, it is <br /> our understanding that the property in the north approach (B Zone), if <br /> and when sewer and water came into those areas, people could subdivide <br /> to help with those costs. Is there a potential problem of interference <br /> with radio communications? Regarding insurance for B and C Zones, will <br /> it be a problem? <br />Response The City Attorney has addressed the points raised by MC and WMMI <br /> separately. A major misconception of Ms. Mager is that currently she <br /> may subdivide her property. This is erroneous since the possibility of <br /> subdivision only would become a reality if and when sewer and water <br /> were provided to the area. No such plans are being considered. Thus <br /> the B Zone restrictions would not take away an existing right and <br /> should not be a basis for litigation. Also, upon checking with an <br /> insurance office it is reasonably certain that the airport rezoning <br /> would not increase insurance costs to the City.
