Case ~6: Easement Acquisition For Industrial Sewer Parcels In Riverside We~t A~d Parcels East Of Sunfish Lake Boulevard (C0ntinu~d): City Engineer Raatikka stated that Mn/DoT approval of the plans has been obtained; the proposed resolution would authorize the City Attorney to obtain easements through negotiations or condemnation. Motion by Councilmember DeLuca and seconded by Councilmember Pearson to table this case until a determination has been made regarding sewer and water alignment and easements south of U.S. Hwy. #10 (Phase II of industrial sewer and water project). Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, DeLuca and Pearson. Voting No: None. Absent: Councilmember Cox was temporarily out of Council Chambers. Case #7: Tru~k Stor~ Sewer Immrovement. Project #87-21: City Engineer Raatikka stated that the project is for trunk storm sewer from the north side of the Burlington Northern Railroad to the Mississippi River; the city must apply for a permit to locate storm sewer in the Burlington right-of-way and it will cost $500 for the first 5 year period and $375 for each subsequent 5 year period. Councilmember Cox noted that Cty. Rd. #83 and #63 are quickly deteriorating because of traffic patterns resulting from Burlington's dictates on railroad crossings; unfair of Burlington to require right-of-way payments to fix drainage problems that their railroad beds contribute to. Motion by Councilmember Cox and seconded by Councilmember Pearson to request that Burlington Northern Railroad waive the right-of-way permit fees. Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, DeLuca and Pearson. Voting No: None. Discussion ensued regarding whether or not the project should proceed in full or a portion thereof that will still qualify for Mn/Dot matching funds. Council determined that whether or not the project proceeds in full at this time, the acquisition of right-of-way is necessary. Motion by Councilmember DeLuca and seconded by Councilmember Sorteberg to authorize the City Attorney to acquire the right-of-way for the trunk storm sewer project #87-21 in accordance with Mn/DoT requirements. Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, DeLuca and Pearson. Voting No: None. Case #9: Review Request For Tax Increment Assistance: Mr. Hartley presented Council with copies of a draft agreement between the City and G.
