requested that Council review the draft. <br /> <br />Case ~8: Discuss Development Permig For Plants And Thin~s; <br /> <br />Mr. Goodrich stated that Mr. Hickman has not yet signed the development <br />permit agreed to in February, 1987 relating to the construction of a pole <br />building at Plants and Things. Mr. Goodrich stated that Mr. Hickman has <br />forwarded a letter stating that he cannot comply with the terms in the <br />agreement because of financial reasons. Mr. Goodrich stated that the <br />letter also states that the agreement is being reviewed by Mr. Hickman's <br />attorney and noted that he has had 10 months to review it. <br /> <br />Mr. Hickman inquired as to why other businesses along Hwy. #10 were not <br />required to do some of the things being required of him, i.e. facing on <br />building, surfaced parking lots, etc. Mr. Hickman stated that he is <br />reluctant to sign the agreement because of it's contents and the cost to <br />fulfill those requirements put on him after-the-fact. <br /> <br />Mr. Goodrich stated that the requirements have been in existence for 5-10 <br />years; Mr. Hickman may not have been aware of them. <br /> <br />Council consensus was that the agreement could be amended to grant a <br />variance to blacktopping the parking area when Mr. Hickman becomes legal <br />owner of the property; that applying facing to the building is extended to <br />June 30, 1988; accessory structure will be for storage and warehouse with <br />no retail activity; and provide for off-street loading on the north side of <br />the subject building. Mr. Hickman agreed to sign the permit as amended. <br /> <br />Mr. Goodrich noted that a variance to blacktopping may be required to go <br />through the public hearing process. <br /> <br />Case #10: Concession Rights/Procedures For Central Park: <br /> <br />Mr. Raatikka informed Council of what Merland Otto found out about how <br />other cities handle concession rights at parks. <br /> <br />Mr. Hartley stated that a policy needs to be established regarding whether <br />there will be active concession sales during special and sporting events <br />only or will it include open skating months; do the concession rights go to <br />the organization sponsoring the event; who will have concession rights for <br />open skating. <br /> <br />Councilmember DeLuca stated that he would be in favor of non-profit <br />organizations operating concessions and having first choice to serve at <br />their own events.
