Mn. 55303 <br /> <br />Re: Right of way for MSA Road South of Hwy 10 <br /> <br />Dear Mayor and Councilmembers: <br /> <br />Back ,wh. en the city first informed us that they were going <br />to build a road across our property, they said it was a <br />reality, that it was going to be constructed whether we <br />liked. ~t Or not. The city then exercised their right of <br />eminen~ domain and served us with condemnation papers to <br />prove'~o us they were dead serious about the construction <br />of this road. <br /> <br />Because'of this condemnation by the city, we accepted the <br />fact th~at ~the road was going to be constructed and in good <br />faith'%~orked with the city engineer to be sure the location <br />of the '~road would be okay. We have incurred considerable <br />expens~ in doing this. <br />On the ~,oth~,r hand, city has not acted in good faith. They <br />have ~bmitted no firm offer to us even though they had an <br />appraislal made of the property° Instead the city requested <br />that W~ donate the property for the road.
