Voting No: None.

COUNCIL BUSINESS

Case ~1: Discuss Sprinkler System For LeTourneau's Super Valu:

Mr. Goodrich stated that after considerable research, it has been
determined that the City can legally grant a variance to sprinkler system
requirements but in doing so, the City accepts a substantial amount of
liability; Building Official Erickson's proposal for a sprinkler system at
LeTourneaus Super Valu, connected to an on-site well with installation of a
pressure tank within a 3 year period is a reasonable compromise.

Mayor Reimann stated that the City has a letter from Mr. LeTourneau stating
he is agreeable to Mr. Erickson's proposal for a sprinkler system at the
Super Valu.

Case #2: Ken Miller Well Problem:

Mr. Hartley noted the agenda contains a chronology of events regarding Mr.
Ken Miller's well. Mr. Hartley stated that Mr. Ken Miller has a well that
is currently not working and the City has a water main in close proximity
to Mr. Miller's property that can serve him with water. Recognizing that
Mr. Miller currently lives in a commercial/industrial area and that the
next use of the property will most likely be commercial/industrial rather
than residential, it has been suggested that Mr. Miller enter into an
agreement with the City that the property would pay for the connection
charge for sewer and water (approximately $7150/acre at today's rates)
that passes by that property at the time the property is transferred or
sold. When the connection charge is paid, it will be an amount
commensurate with rates at that time. Mr. Miller has also offered that he
will extend to the City $I,000 toward the construction costs to connect the
service line from the water main to his house. It is estimated that the
construction costs will be $1800. Therefore, for $800 the City has a
commitment from Mr. Miller that the assessment fees for sewer and water for
that property will be made at some future date and the problem with the
well is resolved.

Council directed that Mr. Hartley and Mr. and Mrs. Ken Miller temporarily
leave Council chambers and review the agreement again with the Millers to
make sure they fully understand the terms .

Refer to page 5 of these minutes for further action.

Case #3:

Request For Sketch Plan Review; Case Of Mr. John Rambosek,
Mr. Dale Voltin and Mr. Dave Schulte;

City Council/December 8, 1987
