111111 n <br />R eror tl ii ID 2 92 91 2 6 <br />Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -10 -201 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A <br />DETACHED ACCESSORY BUILDING THAT ENCROACHES INTO THE REQUIRED <br />SETBACKS FROM THE ORDINARY HIGH WATER MARK OF THE RUM RIVER <br />AND THE FRONT PROPERTY LINE AT 16601 FLUORINE ST NW AND DECLARING <br />TERMS OF SAME <br />WHEREAS, Kimberly M Barry and Michael R Musenbrock, hereinafter referred to as the <br />"Permittee," have properly applied for a variance from Section 117 -256 (District Provisions) and <br />117 -111 (R -1 Residential District) of the Ramsey City Code to construct a detached accessory <br />building within the established river and front yard setbacks on the property generally known as <br />16601 Fluorine St NW and legally described as follows: <br />Lot 8, Block 1, White PinegEstates, Anoka County, Minnesota, subject to easement as <br />shown on the plat <br />(the "Subject Property "). <br />RECEIVED <br />OCT 191D14 <br />WHEREAS, the Planning Commission conducted a public hearing on September 4, 2014, <br />pursuant to Section 117 -53 of the Ramsey City Code and tabled action until the October meeting; <br />and <br />WHEREAS, the Planning Commission reviewed the request again on October 9, 2014. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0934, a Variance to construct a detached accessory building <br />(the "Building ") within the required setbacks to the Ordinary High Water Mark (OHWM) of <br />the Rum River and the front property line on the Subject Property is hereby granted. <br />2. That the Building shall not be located any closer than sixty (60) feet from the OWHM on the <br />Subject Property as shown on Exhibit A. <br />3. That the Building shall not be located any closer than thirty (30) feet from the bluff line on the <br />Subject Property as shown on Exhibit A. <br />4. That the Building shall not be located any closer than twenty -four (24) feet from the front <br />property line of the Subject Property as shown on Exhibit A. <br />5. That the Permittee shall construct the Building in accordance with all other provisions of City <br />Code Section 117 -349 (Accessory Uses and Buildings). <br />2092965.001 <br />
