23. That the Minnesota Department of Natural Resources (MN DNR) was not supportive of
granting the original variance request, primarily due to the substandard setback from the bluff
line but also because of the substandard setback from the OHWM.
24. That the MN DNR has been informed of the revised request and have stated that they find
the revised proposal reasonable with certain mitigation measures, specifically including the
use of rain gutters and down spouts to direct water away from the river and the installation
of at least two (2) native, evergreen trees between the proposed detached accessory building
and the bluff line.
25. That four (4) nearest property owners have stated that as long as the proposed detached
accessory building is constructed using conventional stick -built construction, has siding and
roofing that matches that of the Applicants' principal structure, and includes some stonework
to also match their principal structure, they would not oppose the request.
26. That there may be an alternative location on the Subject Property that would not encroach
upon the minimum OHWM setback or the front yard setback but that location would be more
conspicuous than the proposed location for the rest of the neighborhood.
27. That the proposed use (detached accessory building) is a permitted use in the R -1 Residential
(Rural Developing) zoning district.
28. That the plight is due to circumstances unique to the Subject Property.
29. That the plight was not created by the Applicants.
30. That, if granted, the Variance will not alter the locality's essential character.
31. That, if granted, the Variance will not impair an adequate supply of light and air to adjacent
property.
32. That, if granted, the variance will not have the effect of allowing a use that is prohibited in
the applicable zoning district.
33. That, if granted, the variance will not increase the congestion on the public street.
34. That, if granted, the variance will not adversely impact the degree of public health, safety
and general welfare provided for in the Ramsey City Code.
35. That, if granted, the Variance will not permit standards that are lower than those required by
state law.
36. That, if granted, the variance will not diminish established property values within the
neighborhood.
RESOLUTION #14 -10 -200
