30. Contents of a Notice to Take Action <br /> <br />Selected text was: "Such notice shall describe the kind of tree, shrub, or other plant or plant part <br />which has been declared to be a public nuisance; its location on the property; the reason for <br />declaring it a nuisance. Proper disposal procedures of wood, bark and debris from said nuisance <br />shall be detailed in said notice. These disposal procedures shall be followed within the time <br />provided in the notice. And the notice shall require such property owner to eradicate, remove or <br />otherwise control such condition within 30 days of the date of the notice." <br /> <br />31. Failure to Comply with a Notice to Take Action <br /> <br />Selected text was: "If the owner of the property to whom an order has been issued fails or <br />refuses to take remedial action in accordance with and within the time specified in an order, the <br />Environmental 'Specialist shall cause the remedial action so ordered to be performed at the <br />expense of the owner." <br /> <br />32. Expenses Related to a Notice to Take Action <br /> <br />City Staff was directed to supply text based on current procedures for corrective action when the <br />property owner fails to comply with an order to comply with City Code. <br /> <br />City Staff drafted the following: "If, after such service of notice, the property owner fails to <br />abate the nuisance, the City Council may cause such nuisance to be abated at the expense of the <br />City. The property owner agrees to pay to the CITY all CITY expenses incurred in abating the <br />nuisance, including, but not limited to administration expenses and legal fees. Said expenses <br />shall be paid within fifteen (15) days of billing by the CITY. Failure to pay the CITY'S <br />expenses within the fifteen (15) day billing period will permit the CITY to either: a) initiate <br />civil action against the property owner to recover expenses incurred, plus an additional 25%; or, <br />b) certify the expenses incurred by the City as a special tax against the property, plus an <br />additional 25%, at the offices of the County Auditor for collection in the manner as taxes and <br />special assessments are certified and collected." <br /> <br />33. Treatment for Insect, Disease or Other Problem <br /> <br />Selected text was: "Suitable precautions shall be taken to protect and warn the public that <br />spraying is being done to public trees. Spraying will be done only for the control of specific <br />diseases or insects, with the proper materials in the necessary strength, and applied at the proper <br />time to obtain the desired control. General spraying for insect and disease control is to be <br />discouraged. All spraying practices shall conform to federal, state and local regulations and must <br />be performed by a pesticide applicator properly licensed by the Minnesota Department of <br />Agriculture." <br /> <br />34. Tree Removal and Replacement <br /> <br />Selected text was: "Any tree of historical significance or otherwise significant by reason of its <br />rarity or environmental significance shall be given special consideration and shall not be cut or <br />destroyed unless there is no possible alternative. No person shall remove any public trees." <br /> <br /> <br />
