City Attorney Goodrich replied that that is one of the reasons staff was requesting that action be <br />tabled. <br /> <br />Community Development Director Frolik stated that staff will make sure those issues are <br />addressed when it comes back to the Council. <br /> <br />Cotmcilmember Kurak stated that it was her understanding that the City purchased an easement <br />not the actual property. When they are talking about parks they are talking about ownership of <br />property. <br /> <br />City Attorney Goodrich explained that the City did not acquire fee title of the property, but if the <br />easement is vacated the City would be giving up easement rights. <br /> <br />Community Development Director Frolik noted that they would not be vacating the easement <br />entirely, the easement would have a different configuration. <br /> <br />Councilmcmber Elvig stated that he had thought the City owned part of the property. <br /> <br />City Attorney Goodrich replied that the City acquired an easement over the 3.8 acres. <br /> <br />Councihnember Strommen requested that staff provide a summary of all the information when <br />the case is brought back to the Council. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Pearson, to table action. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Elvig, Pearson, Cook, Kurak, <br />Strommcn, and Zimmerman. Voting No: None. <br /> <br />Case #3: Clandestine Drug Labs <br /> <br />Police Chief Way stated that to reduce public exposure to the health risks from hazardous <br />chemicals at suspected Clandestine Drug Lab Sites or associated dumpsites, notification and <br />cleanup procedures are needed. Such sites may contain suspected chemicals and residues that <br />place people, particularly children or adults of child bearing age, at risk when exposed through <br />inhabiting or visiting the site, now and in the future. Law enforcement must notify appropriate <br />municipal, child protection and public health authorities of the property location, owner, and <br />conditions tbund. Additionally, if there is a determination of the existence of a clandestine drug <br />lab site or chemical dumpsite, the property will be declared a public health nuisance. Property <br />owners are responsible for abatement of the public health nuisance. They must immediately <br />vacate those portions of the property, including building structures, which may place persons at <br />risk. Environmental testing and cleaning finns must also conduct on-site assessments of the <br />property. The property must notify the City of actions taken to clean up the site, and is <br />responsible for all costs of vacation or clean up of the site. <br /> <br />City Council/December 9, 2003 <br /> Page 7 of 23 <br /> <br /> <br />
