Motion by Councilmember Cook, seconded by Councilmember Elvig, to introduce an ordinance <br />amending City Code to add Section 5.17 Clandestine Drug Labs. <br /> <br />Further discussion: Councilmember Kurak stated that subdivision 3 indicates that a fee may be <br />cstablished and inquired as to what that fee will be. City Attorney Goodrich recommended that <br />staff provide a resolution adopting a fee along with the adoption of the ordinance. <br /> <br />Motion carried, Voting Yes: Mayor Gamec, and Councilmembers Cook, Elvig, Kurak, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case fl4: <br /> <br />Request for Final Plat Approval of Riverbrook: Case of Wayne and Marian <br />Meloche <br /> <br />Community Development Director Frolik stated that Wayne and Marian Meloche were <br />requesting final plat approval of a minor subdivision to plat two rural residential lots, consisting <br />of one existing homestead and one additional lot. The subject property is located at 17400 <br />Erkium Street NW. The final plat includes two rural residential lots: one for the existing <br />homestead and one for the applicants' daughter and son-in-law. The subject area is located <br />outside the MUSA and is zoned R-1 Rural Developing. The subject property is also located <br />within the Rum River Scenic River Overlay District. The proposed plat meets the requirements <br />set forth for this district. Additionally, staff has received comments from the DNR, which has no <br />major concerns about the proposed plat. The applicant was granted a variance to the subdivision <br />standards (public road access requirements) by the Board of Adjustment on October 2, 2003. <br />There is no public road that accesses the proposed plat. Staff was recommending that the <br />clevelopment agreement for the plat include language that outlines the applicants and the City's <br />responsibilities for upgrading the private road easement to public road standards. Both lots will <br />be served by septic systems. Park dedication, trail fees, and stormwater management fees will be <br />collccted for the additional lot. <br /> <br />Councilmember Elvig stated that he did not have any concerns with the split of the lot, but he did <br />have a concern with the park dedication recommendation. The City has been discussing the idea <br />ol' implementing a Greenways plan and perhaps this was an opportunity to negotiate with the <br />property owner for a greenway access or an easement for a trail. <br /> <br />Councilmember Cook noted that there is grant money available to protect some of the green <br />spaces in the City. He stated that it may be beneficial to cover the piece of land to protect it as a <br />natural area. <br /> <br />Councilmember S trommen agreed that this would be a perfect opportunity to initiate a project. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Elvig, to table action to allow for <br />more discussion on the Greenway opportunities. <br /> <br />Further discussion: Councihnember Elvig noted that he was not suggesting that the City was <br />going to put a trail througb the property, but the City may be willing to compensate the property <br /> <br />City Council/December 9, 2003 <br /> Page 8 of 23 <br /> <br /> <br />
