Mayor Gamec stated that staff has a lot of concerns about the request and he would like to see <br />thosc issues resolved before they move forward. He noted that he would not be opposed to <br />holding a one item special meeting to move the issue forward if needed, but before that could <br />happen they need to have some questions answered. <br /> <br />CouncJ hnember Elvig stated that with the Charter School property the Council reviewed a plat at <br />a work session, City staff reviewed the plat, and so did the Planning Commission prior to the <br />metes and bound subdivision being approved, which is very different from this request. He <br />stated that he would not vote in favor of approving this request because they are being requested <br />to make fast decision and they have heard from two staff members that they are against the <br />request until they have more infol~nation. <br /> <br />Mi'. Hame replied that the Charter School, when it is platted is Lot 1, Block 1, which is why it <br />was further through the process. On this parcel when the plat goes of record it becomes an outlot <br />which is a place holder for future development. D.R. Horton will have to come before the City <br />for all tile proper approvals. <br /> <br />Councihnember Elvig stated that they are not far enough down the road to know even where <br />easements should be. It is an issue where they are handed information at a meeting with very <br />little information and asked to make a decision. They have to know what they are talking about <br />and he would be willing to make a decision. <br /> <br />City Attorney Goodrich noted that if the plat is recorded it is an outlot, but with the metes and <br />bounds subdivision it does become a lot of record. <br /> <br />Councilmember Strommen stated that staff has raised a lot of concerns and there is not a person <br />on the Council that has not supported the Town Center, but this process is very difficult and she <br />is at a point where enough is enough. They have a process that has to be followed where <br />information is brought to staff and they are allowed to review the information properly and <br />forward that information onto the Council. This body needs to back up their staff and allow them <br />time to review the information. She noted that she would not vote to approve the request. <br /> <br />Mi'. l-fame replicd that he understood the frustration, but he did not think they were asking for <br />anything that would put the City at risk. <br /> <br />Assistant Director of Public Works Olson replied that may be the case unless outlot BB is sold to <br />somcone other than CC and it cannot be built to the same standards. He was very concerned they <br />were putting the cart before the horse. <br /> <br />Counci hnember Zimmem~an stated that he did not think the Council could be asked to go against <br />staff. <br /> <br />Motion by Councihnember Zimme~xnan, seconded by Councilmember Strommen, to find that no <br />unnecessary hardship has been proven therefore the request for a metes and bounds subdivision <br />was denicd. <br /> <br />City Council/December 16, 2003 <br /> Page 29 of 33 <br /> <br /> <br />
