The applicant withdrew their request. <br /> <br />Motion was wifl~drawn based on the fact that the applicant withdrew their request. <br /> <br />Councihnember Elvig stated that he would be willing to attend a special session to address the <br />issue once some of the questions are answered. <br /> <br />Mayor Gamec recommended that the developer work with staff and if the information is <br />available and staff is comfortable with the request he will call a special meeting. <br /> <br />Tim Engen, Ramsey Town Center, LLC, stated that they have done a lot this year for the <br />community and the pressure has been intense for staff and themselves. They are learning the <br />process along the way and are uncovering new legal formations that are going to guide the <br />Ramsey Town Center. They have enormous market pressures that need to start. They are not <br />trying to be disrespectful staff. The difficulty is that there are staff members that are not quite <br />sure how to process information through staff and who handles what. <br /> <br />Case # 14: Consider Right of Way Agreement for Civic Center Drive <br /> <br />Assistant Director of Public Works Olson stated that on September 25, 2003 the City Council <br />approved the final plat of the Ramsey Town Center (RTC). The approval of the RTC final plat <br />was contingent upon working out the details of the easements that are recorded along the south <br />side of the plat. An agreement was presented to the Council for their consideration that was <br />written by the developer and agreed to by both Qwest and Connexus. <br /> <br />Coul~cihnember Zimmerman inquired if the agreement would cost the City any money at this <br />time. <br /> <br />Assistant Director of Public Works Olson replied no. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Elvig, to approve the Right of <br />Way agreement for Civic Center Drive contingent on the conditions outlined and subject to the <br />City Attorney's final review and non-material amendments. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Pearson, Elvig, Cook, Kurak, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #16: Parking Lot Construction for Elmcrest Park <br /> <br />Parks/Utilities Supervisor Riverblood stated that the 2003 Capital Improvement Program <br />identifies $215,000 for the creation of parking lots and the extension of the neighborhood street <br />as a park drive into Ehncrest Park.
