Commissioner Olds concurred and asked if the Park Commission could do anything about this
situation. Parks/Utilities Supervisor Boos indicated there were a number of ways to deal with the
tree conservation issue. He explained there is a tree policy at a City level, but that no Ordinance
was in place with regard to tree conservation. He indicated this leaves the developer to reach an
agreement with the city on tree preservation/conservation.

Chair Cook asked if final plat approval could be held up for The Ponds, based on the fact the
developer did not meet the City's requirements and tree preservation agreement. Parks/Utilities
Supervisor Boos stated this was a difficult question as the developer followed through with what
he thought was correct. He noted the grading plan showed positive grading in each area of this
development for run off, and stated this leaves little room for existing trees.

Chair Cook indicated this type of developer and development could lead the City to creating a
Tree Conservation/Preservation Ordinance so this type of tree harvesting does not happen again.

ADJOURNMENT

Motion by Commissioner Ostrum, seconded by Commissioner Johns, to adjourn the meeting.

Motion carded.

The Park and Recreation Commission meeting adjourned at 6:57 p.m.

Respectfully submitted,

Recording Secretary
TimeSaver Off Site Secretarial, Inc.

Mark Boos
Parks/Utilities Supervisor

Park and Recreation Commission/May 9, 2002
Page 4 of 4
