One is the typical park dedication and <br />the second isi! the conservation easement concept. The City has very few details on the <br />conservation eosement concept and after meeting with the landowner and staff it seemed best to <br />stick with thel park dedication as recommended and acknowledge the unique~ nature of the <br />property. Thelfollowing language was agreed to by Mr. Meloche: "The developer and the City <br />recognize the dnique nature of the plat and its proximity to Trott Brook on its southern boundary. <br />The developer! and the City have a mutual interest in protecting the wetlands adjacent to said <br />Trott Brook ;t~ough the establishment of a permanent conservation easement. The developer <br />and the City agree to negotiate in good faith future terms of a conservation easement over some <br />or all of the d~signated wetlands on the plat; however, bY this provision, the developer is under <br />no obligation }o grant any easement to the. City nor is the City obligated to acquire such an <br />easement from!the developer." <br /> <br />Councilmemb~r Strommen stated that she was comfortable with that language because typically <br />conservation ~asements are voluntarily. <br /> <br />Councilmemb~r ElVig thanked the proPerty owners for their willingness to Work with the City. <br /> <br />Motion by Co~Uncilmember Elvig, seconded by Councilmember Cook, to adopt Resolution #03- <br />12-320 approving the proposed final plat with the language presented by the City Attorney, <br />contingent uPon compliance with City staff review letter dated December 5, 2003. <br /> <br />Motion carried,. VOting Yes: Mayor Gamec, and Councilrnembers Elvig, Cook, Kurak, Pearson, <br />and Strommer~.
