Councilmemb~r Strommen inquired if there was a better alternative to access property to the <br />west that they may consider in the future if this route is so difficult. <br /> <br />Assistant Co '~rr~rnunity Development Director Trudgeon replied that on Mr. Bauer's property there <br />would be no other access. <br /> <br />Motion by Cogncilmember Cook, seconded by Councilmember Kurak, to adopt Resolution #03- <br />12-338A granting final plat approval of Trappers Ridge subject to compliance with City staff <br />review letter .dated December 12, 2003 and the apPlicant entering into a development agreement <br />with the City, ehm~nat~ng 12 from Section IV General. <br /> <br />Further discu~sioni Councilmember Zimmerman inquired if there Was any lead from the <br /> gun <br />club on this:plece of property. Mr. Bauer replied no. Councilmember Zimmerman inquired if <br />there should, b~e language included in the development agreement that holds the City harmless if <br />there is leadfdundon the property. City Attorney Goodrich replied that that could be done. Mr. <br />Bauer stated ~at he would agree to including that language. <br /> <br />Motion was amended to include language in the development agreement that would hold the City <br />harmless if lead is found on the property. <br /> <br />Councilmemb~r Elvig noted that he would be abstaining from the vote. <br /> <br />Further discussion: Councilmember Strommen expressed concern with not acquiring the <br />easement if ti)is is the best access. Assistant Community Development DirectOr Trudgeon <br />replied that .tll:e gun club extends south of this property so there may be some better options. <br />Councilmemb~r Strommen stated that if the location of the easement was the best out of many <br />bad options Sl'ie does not want to lose an opportunity to get an easement, but it seems there is a <br />reasonable alt .c~vnative. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Kurak, Pearson, <br />Strommen, an~!Zimmerman. Voting No: None. Abstained: Councilmember Elvig. <br /> <br />Case #9: <br /> <br />iAdopt Ordinance to Rezone the Holasek/Hamilton Parcel South of Riverdale <br />~Drive NW from B-3 Highway Business to R-1 Residential <br /> <br />Assistant Community Development Director Trudgeon stated that on July 22, 2003, the City <br />Council introd~uced an ordinance to rezone the Hamilton/Holasek parcel south of Riverdale, west <br />of Sunfish Lake Boulevard from B-3 Highway Business to R-1 Residential, in accordance with <br />the Compreheh. sive Plan. On August 12, City Staff presented the ordinance for adoption. City <br />Council tabled action on the ordinance until the August 26th Council meeting to allow the <br />property owners more time to meet with Councilmembers regarding the future land use of this <br />property. At ~e August 26th meeting, the City Council tabled the matter to a future work session <br />for further discussion.
