Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04- - <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-2 BUSINESS <br /> <br /> WHEREAS, on January 20, 2004, the City received an application to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, A~NOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Scott Hagen, hereinafter referred to as "Applicant," has properly applied to rezone <br />certain property from R-2 Medium Density Residential to B-2 Business. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of the <br />City Code on February 5, 2004 and said public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the Property proposed to be rezoned is legally described as follows: <br /> <br />Beginning at a point on the East line of the Southeast Quarter of the Northwest <br />Quarter of Section 29, Township 32, Range 25, 30 feet south of the intersection of <br />said line with the southerly boundary of the right-of-way of U.S. Highway No. 10; <br />thence northwesterly and parallel with said highway and 30 feet southwesterly thereof <br />a distance of 200 feet; thence southerly and parallel with the east line of the said <br />Southeast Quarter of the Northwest Quarter a distance of 400 feet; thence <br />southeasterly and parallel with U.S. Highway No. 10 a distance of 200 feet to the east <br />line of said Southeast Quarter of the Northwest Quarter; thence north along the east <br />line of the Southeast Quarter of the Northwest Quarter a distance of 400 feet to point <br />of beg/nning. <br /> <br />Together with an easement for ingress and egress to U.S. Highway No. 10 over and <br />across, the 30 foot strip of land between said Highway and the property above <br />described. <br /> <br />4. That the area of the property to be rezoned is approximately 1.5 acres in size. <br /> <br />5. Prior to adoption of the 2001 Comprehensive Plan and subsequent re-zoning, the Subject <br /> Property was zoned Highway Business. <br /> <br />That the Subject Property contains an existing bUsiness that was a permitted use in the <br />Highway Business District. <br /> <br />31 <br /> <br /> <br />
