4) That ~he 4isplay or storage of motor or recreational vehicles on the Subject Property shall be <br /> restricted ~o those areas that maintain the required improvements. Violation of this provision <br /> or any other provision will be cause for revocation of the motor vehicle sales license. <br /> <br />5) That the Permittee shall be responsible for obtaining a permit from the Lower Rum River <br /> Watershe.d Management Organization and any additional permits required by other applicable <br /> regulatory agencies. <br /> <br />6) <br /> <br />That the lPermittee shall provide a financial guarantee to the 'City, guaranteeing the <br />construction and timely completion of the required site improvements described herein. The <br />financial guarantee shall be in the amount of Seventeen Thousand Eight Hundred and no <br />cents ($17,800.00), which amount is 125% of the City Engineer's estimated cost of the <br />required ~ite improvements. The form and issuer of the financial guarantee shall be subject <br />to the approval of the City. The financial guarantee shall be deposited with the City prior to <br />the construction and installation of the second product silo on the Subject Property. Upon <br />total completion of the site improvements and acceptance bY City,'the Permittee may request <br />a total red~3ction in the amount of the financial guarantee. <br /> <br />7) That this Permit shall not be considered modified, altered, changed or amended in any respect <br /> unless in ~riting and signed by the City and the Permit-tee. <br /> <br />8) That the C. ity shall have the right to inspect the premises for compliance and safety purposes <br /> [ . <br /> annually or at any t~me, upon reasonable request. <br /> <br />9) That the terms of this Permit shall be binding upon its successors and assigns. <br /> <br />10) [n the eve~t~t the Permittee, or its successors, or assigns,' violates the terms of this Permit, said <br /> violation Shall be grounds for suspension or revocation pursuant to Section 9.03.04 Subd. 9 <br /> of the City Code. <br /> <br />1 I) In the event any part of this IUP is declared void or unenforceable by a court or competent <br /> jurisdiction, the other provisions shall not be affected but shall remain in full force and effect. <br /> <br />12) That all ¢~osts incurred by the City in administering and enforcing this Permit shall be the <br /> responsibility of the Permittee. <br /> <br />The motionl for the adoption of the foregoing resolution was duly seconded by <br />Councilmem§er , and upon vote being taken thereon, the following voted in favor <br />thereof': <br /> <br />and the t:bllowing voted against the same: <br /> <br />and the t'blloWing abstained: <br /> <br />and the folloWing were absent: <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the~ ~day of'February, 2004. <br /> <br />RESOLUTION #04-02~ <br />Page 3 of 4 <br /> <br /> <br />
