That part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, described as follows: Begim~ing at the point of intersection of the west line of said Northeast Quarter of the Southwest Quarter with the southerly right of way line of the Burlington Northern Railroad; thence southerly along said west line of said Northeast Quarter of the Southwest Quarter to its intersection with the northerly right of way line of U.S. Highway No. 10; thence southeasterly along said northerly fight of way line of said U.S. Trunk Highway No. 10 a distance of 485.00 feet to the actual point of beginning of the tract to be herein described; thence continuing along the northerly right of way of said highway a distance of 140 feet; thence northerly to a point on said southerly right of way line of said Burlington Northern Railroad distant 691.80 feet southeasterly from the west line of the Northeast Quarter of the Southwest Quarter as measured along the southerly right of way of the Burlington Northern Railroad; thence northwesterly along said southerly right of way line of said Burlington Northern Railroad a distance of 140 feet; thence southwesterly to the point of beginning. (the "Subject Property") YVHE~AS, The Planning Commission met on February 5, 2004, conducted a public hearing and recormnended that the City Council approve the request for an Interim Use Permit; and; WHEREAS, The City Council met on Februa~ 24, 2004 to review the request for an Interim Use Permit to allow for motor and recreational vehicle storage and display on the Subject Property, in the absence of the required bituminous pavement and concrete curbing requirement for an interim period of time. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This Permit is issued pursuant to Section 9.03.04A of the Ramsey City Code. The conditions of this Permit are as follows: 1) That the Permittee shall be permitted to store and display motor and recreational vehicles on the Subject Property on an existing Class 5 surface without the benefit of the required paved and curbed customer, employee, and vehicle display areas until June 30, 2004. 2) That the Permittee will be required to submit a grading and pavement plan prepared by a certified engineer prior to any improvements being initiated on the Subject Property. The grading and pavement plan will be subject to the review and approval of the City Engineer. 3) That the Permittee shall complete pavement and curbing improvements identified on the site drawing by June 30, 2004. 56 RESOLUTION #04-02- Page 2 ot'4
