Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property: Staffsent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property, is approximately 1.36 acres (59,241 square feet) in size and is located <br />outside the Metropolitan Urban Service Area (MUSA). According to City Code, the property is <br />eligible for 1,664 square feet of accessory building space. The proposed building will be 806 <br />square feet (26' x 3 t') in size. Coup[ed with the existing garage (937 sq. ft.), the applicant will <br />have t,743 sq. ft. in accessory, buildings. This results in an overage of seventy-nine (79) square <br />feet. The applicant would like to exceed the 1,664 square feet restriction in order to construct a <br />detached accessory, building that would accommodate the storage of several trailers and other <br />equipment. <br /> <br />The proposed detached accessory, building will be located north and west of the principal <br />structure. The proposed accessory, building location will meet the ten (10) toot side yard and five <br />(5) foot rear yard setbacks established in the Rural Developing Bulk Standards. However, the <br />applicant is requesting to construct the accessory structure nearer tb.e front property line than the <br />principal structure due to the slope of the yard. The applicant has applied for a variance to the <br />front yard setback, which is [brty (40) feet or same as the principal structure, whichever is <br />geater. <br /> <br />The proposed building location will also require a variance to the 200 foot setback from Rogers <br />Lake, which is classified as a Natural Environment Lake. Rogers Lake also extends into Bums <br />and Oak Grove. Those communities have classified Rogers Lake as a Recreational Development <br />Lake, ~br which the structure setback from ordinary high water mark' is 100 feet. City Staff are <br />currently drafting an ordinance to update Chapter 9 (Zoning and Subdivision of Land) of the <br />Ramsey City Code. Staff will be proposing, for purposes of consistency, to reclassify Rogers <br />Lake within the city limits of Ramsey to a Recreational Development Lake, like Oak Grove and <br />Bums. If Rogers Lake is reclassified in the future to a Recreational Development Lake, it would <br />eliminate the need for this variance and the proposed setback would be conforming'. <br /> <br />Recommendation: <br /> <br />Staff is recommending approval of Jeff and Barbara Rockow's request for a Conditional Use <br />Permit to exceed the accessou, building size restriction established in City Code. <br /> <br /> <br />
