CASE #

INTRODUCE ORDINANCE TO REZONE CERTAIN PROPERTY
FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-2 BUSINESS;
CASE OF SCOTT HAGEN.
By: Amy Geisler, Associate Planner

Background:

Scott Hagen: (Owner of Hi-Ten Sports) has requested that the City rezone his property south of
Highway 10, west of Llama Street from R-2 Medium Density Residential to B-2 Business.

The following items are enclosed for your information:

a) Site location map
b) Exhibit showing property subject to rezoning
c) Proposed Findings of Fact
d) Proposed Ordinance

Notification:

State statute requires that property owners within 350 feet of the subject property be notified of
the public hearing.

Observations:

As discussed in the previous Comprehensive Plan Amendment case, it appears that the subject
property was '.inadvertently shown as Residential in the 2001 Comprehensive Plan and
subsequently zoned R-2 Residential. Along with changing the subject property's Land Use
designation back to Places to Shop, the parcel's zoning must also be changed back to B-2
Business. Staff is also recommending the City Council waive the Zoning Amendment
application fee.

Recommendation:

The Planning Commission and City Staff recommend approval of the rezoning and waiver of the
Zoning Amendment application fee.
