Chairperson Nixt asked what would happen if a building is not currently in use and the owner wanted to use ii. Associate Planner Wald stated they would have to apply for an SUP and go through site plan review. Assistant Community Development Director Trudgeon stated in Staff's minds this ordinance allows the owners to reasonably use their land until such time as the City knows what will happen, while at the same time preventing a million and a half dollar expansion when it is not appropriate. Chairperson Ni~xt argued that if you currently have 0% coverage and wanted 2%, you would have to come to the City for approval. Assistant Community Development Director Trudgeon noted you would have to in any case in a B-2 District. Associate Planner Wald commented the SUP is sort of like a CUP, where you can do it, with conditions. She gave an example ora business wanting to put up a building that was 100% brick. The City may give them permission to use only 50% brick, so the building is not so expensive. Commissioner 'Johnson asked if the City is affirmatively looking at acquiring property for Highway 10. Assistant Community Development Director Trudgeon stated they are doing an AUAR of the Highway 10 corridor for mapping, which puts everyone on official notice. This gives the City the ability to apply for funding for land acquisition. Chairperson Nixt summarized the letter from the law firm representing Highway 10 businesses, indicated it stated while the ordinance is reasonable, it is not appropriate. The letter objects to 25% coverage, .noting it is significantly less than the 35% allowed in B-2, and claims that by limiting use of. the property the City intends to devalue the land. It claims the City Council assured that theresults of the Tinklenberg Group would be made public, and those results should be made available before the City adopts this ordinance. It stated a change in the development rights along the corridor is not in the City's best interest, making note again it is not appropriate. Assistant Community Development Director Trudgeon indicated the AUAR will be ready for final adoption in December, which is not the report the letter is referring to from the Tinklenberg Group. He stated the City is progressing with the expectation that official mapping will take place in the spring. Chairperson Ni~t asked what the chances are the ordinance can still pass when needed if they delay it for re-writes.
