COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Request for an Interim Use Permit to Allow for Outdoor Storage in the E-2 <br />Employment District; Case of Bruce Volk <br /> <br />Assistant Community Development Director Trudgeon explained that Bruce Volk of B & A <br />Cylinder has submitted an application for an Interim Use Permit to allow for outdoor storage of <br />Recreational V~hicles (RV) as a secondary principal use on the property located at 14165 <br />Ramsey Boulevard. Mr. Volk's property is approximately 4.5 acres in size and is zoned E-2 <br />Employment. Mr. Volk is operating a manufacturing facility as the principal use on the subject <br />property. The aPplicant is also storing RV's on the property, which is considered a secondary <br />principal use operating on the property. City Code states that there shall be one principal use <br />operating on a property. On March 24, 2003, the City sent Mr. Volk a letter notifying him that <br />storing RV's on his property was in violation of City Code and he needed to remove the items <br />from his prope/'ty or discuss other options with the City. Mr. Volk would like to continue to <br />store RV's for :RV World and, therefore, submitted an application requesting an interim use <br />permit to store recreational vehicles as a principal secondary use on his property from December <br />1 to August 1 of every year. The Planning Commission held a public hearing and reviewed the <br />request at their November 6, 2003 meeting. During the public heating, the applicants stated their <br />objection to installing a Class 5 surface where the RV's will be stored. They are concerned with <br />making the investment of installing a Class 5 surface if the permit is to expire in two years. The <br />applicants stated they would be willing to provide lawn maintenance on a weekly basis in lieu of <br />installing a Class 5 surface. The Planning Commission recommended that the City Council <br />approve the Interim Use Permit to allow B&A Cylinder to store RV's and travel trailers as a <br />secondary principal use on the subject property until August 1, 2005. The Planning Commission <br />also recommended that the IUP include language requiring the applicant to provide lawn <br />maintenance on'a weekly basis within the area where the RV's will be parked. <br /> <br />Councilmember Elvig inquired if Mr. Volk's property was in the moratorium. <br /> <br />Assistant Community Development Director Trudgeon replied no. <br /> <br />City Administrator Norman stated that the property may not be in the 'moratorium, but it is .near <br />the Town cent~er and part of the study area for the interchanges. He noted that Mr. Volks <br />property could eventually be a' ramp, which is why staff was r6commending an interim use <br />permit. <br /> <br />Mayor Gamec expressed concern that in the past the City has required that any outside storage be <br />done on a gravel surface. He inquired if they grant an interim use permit on a yearly basis how <br />often can they renew the permit. <br /> <br />Assistant Community Development Director Trudgeon explained that an interim use permit can <br />be in place for a maximum of five years. Staff is recommending a two-year interim use permit <br />because that is about the time the majority of the development will be occurring within the Town <br />Center. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to adopt Resolution #03- <br />11-304 adopting Findings of Fact #0658 relating to a request from Bruce Volk for an interim use <br /> <br />City Council/November 25, 2003 <br /> Page 6 of 28 <br /> <br /> <br />
