Mayor Gamec replied yes. <br /> <br />Case #2: Request for a Conditional Use Permit for an Oversized Accessory Building; <br /> Case of Don Volner <br /> <br />Community Development Director Frolik explained that the City received an application from <br />Don Volner for a conditional use permit to exceed the accessory building size restrictions <br />established in City Code on the property located at 8121 154th Ave. NW. The subject property is <br />approximately 0.86 acres (37,464 square feet) in size and is located outside the Metropolitan <br />Urban Service Area (MUSA). Under City Code, parcelS between 14,880 sq. ft. and 43,559 sq. ft. <br />can have up t0 1,488 square feet of accessory building space. The proposed building will be <br />1,820 square feet (28' x 65') in size. Coupled with the existing garage (484 sq. ft.) and shed (192 <br />sq. ft.), the applicant would have 2,496 sq. ft. in accessory building space. However, Mr. Volner <br />has stated that the existing shed would be removed and that the existing attached garage will be <br />converted into living space prior to the final inspection of the proposed accessory structure. The <br />net result will be an overage 0£332 square feet. Mr. Volner has also agreed to submit a surety, in <br />the amount of.$2,000, to ensure that this work will transpire prior to the cgmpletion of the <br />proposed structure. The City would not issue a building permit for this structure until the surety <br />has been submitted. 'The Planning Commission conducted a public hearing on November 6, <br />2003, and there were no verbal comments regarding this request. However, there was one <br />written comment submitted from an anonymous source concerning the possibility of a machine <br />shop being operated in the accessory structure. Staffhas informed the applicant that no business <br />use is permitted without a permit. The Planning Commission recommended the City Council <br />approve the conditional use permit request. <br /> <br />Councilmember Kurak inquired as to where the cars will be parked. <br /> <br />Don Volner, 8121 154th Avenue NW, replied that the cars will be stored in the new building. <br /> <br />Councilmember Kurak stated that the City has been receiving a lot of overage requests and <br />inquired if that is that going to be changed during the re-write of Chapter 9. <br /> <br />Community Development Director Frolik replied no. She explained that there are a lot of <br />requests for accessory structure size overage but once people find out the process and the money <br />that is required most people don't pursue it. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Elvig, to adopt Resolution <br /># 03-11-306 adopting Findings of Fact #0659 relating to Don Volner's request for a conditional <br />use peri, it for an oversized accessory building on the property at 8121 154th Ave NW. <br /> <br />Motion carfied~ Voting Yes: Mayor Gamec, and Councilmembers Zimmerman, Elvig, Cook, <br />Kurak, Pearson, and Strommen.
