Councilmember Kurak stated that she did not think it was unreasonable to require a setback of <br />one to two feet. How the fence may impact trees on the property is more of an issue for the <br />landowner. She was not sure why they would need to have three live wires because she owned <br />horses and only had one live wire. She noted that she could agree with a wire fence because it is <br />very costly to construct a wood fence around such a large parcel, but the setback of six inches is <br />not cnough. Ms. Kurak stated that she would be opposed to approving a wire electric fence that <br />close to the property line. <br /> <br />Mr. Konzak replied that the original reason for the three electric wires was to prevent a horse <br />from going over or under a fence. They had a 30-foot setback before and the neighbors moved <br />stuff onto his property up to the 30 feet. Because there is such abuse of people dumping stuff on <br />their property he would be willing to give up the electric fence and just establish the property <br />line. <br /> <br />Councilmember Kurak noted that she did believe the three hot wires was "overkill". She also <br />felt strongly that the setback was an issue. <br /> <br />Mr. Konzak stated that at this time he can't go through the trees but once the loggers are done <br />clearing out some of the trees they could possibly make some changes. He questioned what the <br />purpose would be to require a three to four foot setback. <br /> <br />Councihnember Kurak replied that agreeing to a three to four foot setback would bring an <br />agreement with the neighbors. <br /> <br />Mr. Konzak replied that none of the neighbors have a fence in their backyard and if someone <br />comes up to a fence they are going to do it no matter where the fence is located. <br /> <br />Councilmember Kurak stated that she does understand that horses are something that children do <br />like to go next to, but she felt the Konzaks would be on better ground as a property owner if they <br />have people coming onto his property rather than having his horses reaching over onto another <br />person's property. <br /> <br />Terri Kubat, 6530 - 167th Avenue NW, Ramsey, stated that Mr. Konzak had told them that the <br />City had approved the fence to be located close to the property line; that is when the surrounding <br />property owners became upset. The area is not that rural where they should be able to use eight <br />wires for a fence. <br /> <br />Ms. Heaton reviewed a letter they received from the City of Ramsey on August 6, 2003, which <br />indicated that an attempt would be made to place the fence one to three feet from the property <br />line. <br /> <br />Councihnember Strommen inquired if staff was made aware that the Konzaks were not able to <br />meet the one to three foot setback or was staff not aware of that until after the fence was <br />installed. <br /> <br />Community Development Director Frolik replied that staff was not aware as to location of the <br />fence until after it was being installed. <br /> <br />City Council/January 13, 2004 <br /> Page 13 of 24 <br /> <br /> <br />
